ry BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS:,FOLLOWS:

Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iota, at 5 : 30 p.m. on the 2nd day of May, 2005, for the purpose
of- considering and acting upon a proposal to vacate a portion of
right-of-way generally located at the southwest corner of Heath
Strdet and U. S. Highway 63 and legally described as follows :
A `part of the Southeast 3,1 of Section 11-89-13,
Waterloo, Black Hawk County, Iowa, and a part of Lot 8,
Auditor Barnes' Plat No. 1, Waterloo, Black Hawk
County, Iowa, described as follows :
Beginning at the intersection of the Westerly right-of-
way line of U. S. 63 (Logan Avenue) and the Southerly
right-of-way line of Heath Street; thence South
14°36' 00" West a distance of 46. 49 feet; thence South
00°30' 30" East a distance of 323 . 59 feet to the
Southerly line of said Lot 8; thence North 89°33' 53"
East along the Southerly line of said Lot 8 a distance
of 27 . 00 feet to the Southeast corner of said Lot 8;
North 00°30' 30" West along the Easterly line of said
Lot 8 and its extension thereof a distance of 368 . 47
feet; thence South 89°29' 30" West a distance of 14 . 88
feet to the point of beginning, subject to the City' s
retention of an easement over, under and above the
above described property, all in the City of Waterloo,
Black Hawk County, Iowa.
The East line of said Lot 8 is assumed to bear South
00°30' 30" East, all in the City of Waterloo, Black Hawk
County, Iowa.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 18th day of April, 2005 .
