RESOLUTION NO. 2005-330
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF THE EASTERLY 101' X 25' PORTION
OF PROPERTY GENERALLY LOCATED WITHIN REGAL
AVENUE AND THE ALLEY ABUTTING PROPERTY TO THE
EAST, AS MAY 2, 2005, AT 5 : 30 P.M. IN CITY
HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING AND RESCINDING ORDINANCE
NO. 4369 IN ITS ENTIRETY.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 5 : 30 p.m. on the 2nd day of May, 2005, for the purpose
of considering and acting upon a proposal to vacate the easterly
101' x 25' portion of property generally located within Regal
Avenue and the alley abutting property to the east and legally
described as follows :
That part of the North twenty five feet (25' ) of Regal
Avenue that lies East of a line drawn from a point on
the South line of Regal Avenue that is forty seven and
ninety-four one-hundredths feet (47 . 94' ) East of the
Northwest corner of Lot 1 Block 109 Riverview Addition,
perpendicular to the North line of Regal Avenue; and
West of a line that is an extension Southeasterly of
the Easterly line of Lot 68 in Kenwood Park Second
Addition, subject to the City' s retention of a
permanent public easement over, under and above
described property, all being in the City of Waterloo,
Black Hawk County, Iowa.
Also, that part of the South twenty five feet (25' ) of
Regal Avenue that lies East of a line drawn from a
point on the South line of Regal Avenue that is forty
seven and ninety-four one-hundredths feet (47 . 94' ) East
of the Northwest corner of Lot 1 Block 109 Riverview
Addition, perpendicular to the North line of Regal
Avenue, and West of the Easterly line extended of the
alley platted Easterly and adjacent to Block 109
Riverview Addition, subject to the City' s retention of
a permanent public easement over, under and above
described property, all being in the City of Waterloo,
Black Hawk County, Iowa.
Also, that portion of the ten foot (10' ) wide platted
alley lying Easterly of and adjacent to Block 109
Riverview Addition that lies Northerly of a line that
is an extension of the Southerly line of Lot 8 Block
109 Riverview Addition, all being in the City of
Waterloo, Black Hawk County, Iowa.
Section 2 That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Couriei. .
