RESOLUTION NO. 2005-343
RESOLUTION APPROVING SITE PLAN AMENDMENT TO
THE "S-1" SHOPPING CENTER COMMERCIAL DISTRICT
FOR POINT BUILDERS LLC ON BEHALF OF SHI ZHONG
ZHENG FOR PROPERTY GENERALLY LOCATED NEAR THE
SOUTHWESTERLY CORNER OF SAN MARNAN DRIVE AND
SEARS STREET FOR THE PURPOSE OF CONSTRUCTING A
NEW RESTAURANT IN THE CITY OF WATERLOO, BLACK
HAWK COUNTY, IOWA.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve a site plan amendment to the "S-1"
Shopping Center Commercial District for Point Builders LLC on
behalf of Shi Zhong Zheng for property generally located near the
southwesterly corner of San Marnan Drive and Sears Street for the
purpose of constructing a new restaurant, and legally described
as follows:
A parcel of land located in the East ' of Section 2-88-
13, Waterloo, Black Hawk County, Iowa, described as
follows :
Commencing at the intersection of the Southeasterly
right-of-way line of E. San Marnan Drive and the
Southwesterly right-of-way line of Sears Street; thence
South 41°24' 00" East along the Southwesterly right-of-
way line of Sears Street a distance of 194 . 51 feet;
thence Southerly along a curve concave Westerly having
a radius of 20 . 00 feet a distance of 31 . 42 feet to the
Northwesterly right-of-way line of Crossroads
Boulevard; thence South 48°36' 00" West along the
Northwesterly right-of-way line of Crossroads Boulevard
a distance of 220 . 00 feet to the point of beginning:
thence North 41°24' 00" West a distance of 250 . 00 feet;
thence South 48°36' 00" West a distance of 209. 82 feet;
thence South 41°24' 00" East a distance of 250 . 00 feet;
thence North 48°36' 00" East along the Northwesterly
right-of-way line of Crossroads Boulevard a distance of
209 . 82 feet to the point of beginning.
The Southwesterly right-of-way line of Sears Street is
assumed to bear South 41°24' 00" East, all in the City
of Waterloo, Black Hawk County, Iowa.
WHEREAS, a public hearing was held on April 25, 2005, at
5 : 30 p.m. , at City Hall Council Chambers, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to approve said above mentioned site plan amendment,
and
WHEREAS, it is the opinion of this Council that said site
plan amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that a site plan amendment to the "S-1"
Shopping Center Commercial District for property generally
located near the southwesterly corner .�f San Marnan Drive and
Sears Street for the purpose of constru Ting a new restaurant, be
and the same is hereby approved.
