RESOLUTION NO. 2005-360 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is in conjunction with construction of the Ansborough Avenue Interchange Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owners thereof, and the deed for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds. The subject parcel is: Ronald A. and Linda S. Wagner Parcel No. 8813-08-276-015 and 8813-08-276-017 Relocation Cost - $50, 350 . 00 (8813-08-276-015) Relocation Cost - $4, 368 . 00 (8813-08-276-017) Moving Costs - $3, 750 . 00 Incidental Costs - Not to exceed $5, 000 . 00 Total Acquisition - $250, 000. 00 That part of the Southeast Quarter of the Northeast Quarter of Section No. 8, Township No. 88 North, Range No. 13 West of the 5th P.M. , Black Hawk County, Iowa, that lies within the following described boundaries, to-wit : Commencing at the Northeast corner of the said Southeast Quarter of the Northeast Quarter, and running thence West at right angles along the North line of said Southeast Quarter of the Northeast Quarter 477 feet, thence South 567 feet along a line that is parallel with the East line of said Section; thence East 477 feet to a point on the East line of said Section that is 567 feet South of the point of beginning, and thence North along the East line of said Section 567 feet to the point of beginning, except the South 290 feet of the North 517 feet of the East 452 feet thereof, and also except that part thereof condemned in 540 LD 804 ; And That part of the Southeast Quart;-r of the Northeast Quarter of Section No. 8, Township No. 88 North, Range 13 West of the 5th P.M. , Black iawk County, Iowa, described as follows : Commencing at the East Quarter corner of said Section No. 8, then - North 00°03 ' West, J 77 J :v ,-7 t Resolution No. 2005-360 _YAge 2 . tr' J G, r. 752 . 4 feet along the East line of the Northeast Quarter of said Section No. 8; thence South 89°57 ' West, 72 . 5 feet to the point of beginning; thence South 89°21 ' v s H West, 58 . 2 feet; thence North 00°03 ' West, 50 . 0 feet; thence North 89°21 ' East, 50 . 7 feet; thence South 08°35 ' East, 50 . 5 feet to the point of beginning. c And s > - J s >.- -.
