RESOLUTION NO. 2005-495
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE SERVICE LINE AND PREVENTION OF FURTHER
DAMAGE AT 2316 FALLS AVENUE.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owner of the premises known as 2316 Falls Avenue to
have the service line repaired and further damage prevented, and
WHEREAS, the property owner failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 2316 Falls Avenue, in
the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of
the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 26th day of May, 2005, a report filing claim
for the repairing of the service line and preventing further
damage at above described premises and same met all the
requirements of the City ordinance and have been fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:
Ian Sunil Crowther-Green, Owner
2316 Falls Avenue, Waterloo, Iowa
Legal Description:
Lot No. Two Hundred Thirty-two (232) and the
Northeasterly Ten (10) feet of Lot No. Two Hundred
Thirty-one (231) and the South One-half of the alley
lying adjacent to said Lots, all in First Addition to
Galloway, all in the City of Waterloo, Black Hawk
County, Iowa.
Unpaid Assessment : $1, 750 . 00
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 2316 Falls Avenue in the City of
Waterloo, Iowa, the amount of $1, 750 . 00, said assessment shall
bear interest from the date of levy of the assessment, viz : June
6, 2005, at the rate of nine (9) percent per annum until paid on
all the unpaid amount of this assessment certified to the County
Treasurer of Black Hawk County, Iowa, and
BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby instructed to notify Ian Sunil Crowther-Green of said
property, accordingly and also instructed to certify said
assessment to the County Treasurer of Black Hawk County, Iowa, to
be entered upon the tax list to be collected as other taxes, as
provided by law, and when collected to be credited to the Water
Works Fund of said City, and assessment to be made over a ten-
year period.
