RESOLUTION NO. 2005-575 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is in conjunction with construction of the Ansborough Avenue Interchange Project . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owners thereof, and the deed for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds . The subject parcel is : Duane and Danita Stoner Parcel No. 8813-08-276-006 Fee Simple Acquisition - $13, 500 . 00 Incidental Costs - Not to exceed $2, 000 . 00 A parcel of land located in the Southeast of the Northeast k of Section 8, Township 88 North, Range 13 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, more particularly described as follows : Commencing at the East k corner of said Section 8; thence North 00° (Degrees) 19' (Minutes) 55" (Seconds) West (assumed bearing for the purpose of this description) on the East line of the Northeast k of said Section 8 a distance of 367 . 59 feet (measured and record) ; thence South 89°04' 21" West a distance of 32 . 90 feet to the present West right-of-way line of Ansborough Avenue; thence continuing South 89°04' 21" West on the present West right-of-way line of Ansborough Avenue a distance of 22 . 00 feet to the point of beginning of the parcel herein described; thence continuing South 89°04' 21" West a distance of 5. 11 feet; thence North 00°19' 55" West a distance of 64 . 01 feet; thence North 05°08' 24" West a distance of 119. 31 feet; thence North 89°04' 21" East a distance of 19. 40 feet to the present West right-of-way line of Ansborough Avenue; thence South 00°19' 20" East on the present West right-of-way line of Ansborough Avenue a distance of 43. 02 feet; thence South 89°40' 05" West on the present West right-of-way line of Ansborough Avenue a distance of 4 . 29 feet; thence South 00°19' 55" East on the present West right-of-way line of Ansborough Avenue Resolution No. 2005-575 Page 2 a distance of 140 . 02 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa.
