RESOLUTION NO. 2005-595 RESOLUTION GRANTING PERMISSION TO DONALD BEENKEN FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE LOCATED AT 1005 SHORT STREET, AND AUTHORIZING CONSTRUCTION OF A CONCRETE DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: WHEREAS, the City Engineer has made written application to the City Council asking that Donald Beenken be authorized and permitted to construct a concrete driveway and authorizing construction of a concrete driveway and placing a driveway or sidewalk on city right-of-way on an unimproved street to be located at 1005 Short Street, and legally described as fol7,ows: Unplatted Waterloo East a portion of land commencing 635 feet East and 357 . 46 feet North of center point Section 29 and extending North 140 feet parallel with North and South center line thence West 147 feet parallel East and West center line thence South 140 feet parallel North and South center line thence East 147 feet to point of beginning Section 29 Township 89 Range 12, all in the City of Waterloo, Black Hawk County, Iowa; and WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Donald Beenken to construct a concrete driveway subject to the following conditions : 1 . Work to be performed by an approved and bonded contractor. 2 . A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be performed under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
