RESOLUTION NO. 2005-597
RESOLUTION GRANTING PERMISSION TO STEVEN J.
VOGEL FOR A WAIVER FOR A CONCRETE DRIVEWAY TO
BE LOCATED AT 1022 SHORT STREET, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK
ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Steven J. Vogel be authorized and
permitted to construct a concrete driveway and authorizing
construction of a concrete driveway and placing a driveway or
sidewalk on city right-of-way on an unimproved street to be
located at 1022 Short Street, and legally described as follows:
A part of the Southwest of the Northeast 1,1 of Section
29-89-12, Waterloo, Black Hawk County, Iowa, described
as follows :
Beginning at a point which is 685 feet East and 357 . 6
feet North of the Center of said Section 29 to a found
iron pin with a plastic cap number 9961 as described on
Warranty Deed recorded in Fee Book 2003 11170, Black
Hawk County; thence North 00°22' 53" East (assumed
bearing) a distance of 93. 00 feet; thence North
00°23' 04" East a distance of 46. 87 feet; thence North
00°18' 42" East a distance of 46. 51 feet to the point of
beginning; thence North 00°18' 42" East a distance of
93 . 38 feet; thence South 89°25' 13" East a distance of
150 . 18 feet; thence South 00°24' 36" West a distance of
93. 32 feet; thence North 89°26' 28" West a distance of
150 . 02 feet to the point of beginning, all in the City
of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Steven J. Vogel to construct a concrete driveway
subject to the following conditions:
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
