RESOLUTION NO. 2005-709
RESOLUTION GRANTING PERMISSION TO STEVE
RIEGER FOR A WAIVER FOR AN ASPHALT DRIVEWAY
TO BE LOCATED AT 2703 HUNTINGTON ROAD, AND
AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Steve Rieger be authorized and
permitted to construct an asphalt driveway and authorizing
construction of an asphalt driveway with the elimination of the
sidewalk section to be located at 2703 Huntington Road, and
legally described as follows :
Northwest Southeast except East 190 feet South 80 feet
Section 29 Township 89 Range 13 except that part of
Southeast 4 Section 29 Township 89 Range 13 described
as follows : Commencing at Northwest corner of Southeast
4 thence due East along North line of said Southeast 4
348 . 4 feet thence South 33 feet to South right-of-way
line of Huntington Road being point of beginning thence
due East along said South right-of-way line a distance
of 896 feet thence South 08 degrees 00 minutes West
143 . 4 feet thence South 41 degrees 15 minutes 30
seconds West 299. 1 feet thence due West 678 . 8 feet
thence North 366. 8 feet to point of beginning and
easement, all in the City of Waterloo, Black Hawk
County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Steve Rieger to construct an asphalt driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
PASSED AND ADOPTED this 8th day of August, 2005.
