� v RESOLUTION ORDERING THE CONSTRUCTION OF THE
s = F.Y. 2006 SIDEWALK REPAIR ASSESSMENT PROGRAM
- ZONE 5, CONTRACT NO. 691 .
Uv. WHEREAS, by Resolution No. 2005-744, plans, specifications,
for the F. Y. 2006 Sidewalk Repair Assessment Program - Zone
o5 known as Contract No. 691, in the City of Waterloo, Iowa, have
been approved and adopted by this Council after the hearing
q- = ,prescribed by statute.

1-1NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
r-. J WATERLOO, IOWA, that it is deemed advisable and necessary and it
E_, sis so ordered on motion by this Council that the said improvements
tibe constructed in accordance with said plans and specifications .
r" y That the work herein ordered is to be paid in monthly
='estimates, in cash, on the basis of 90 percent of the work as the

=same is completed and materials delivered and the work approved,
o except that before the last month' s payment is made the contractor
cmay be required to furnish the City Council vouchers showing that
all subcontractors and workmen and persons furnishing materials
have been fully paid for such materials and labor, and that the
City may retain the last month' s payment for a period of 31 days
following such completion and approval, unless satisfied that
materials, men and laborers have been paid.
That said work shall be done by contract and shall be
commenced promptly after receipt of "Notice to Proceed" .
PASSED AND ADOPTED this 15th day of August, 2005 .
