RESOLUTION NO. 2005-851
RESOLUTION APPROVING THE REQUEST OF ISLE OF
CAPRI FOR A SITE PLAN AMENDMENT TO THE "C-P"
PLANNED COMMERCIAL DISTRICT FOR PROPERTY
GENERALLY LOCATED ALONG HIGHWAY 218, JUST
EAST OF THE LOST ISLAND WATER PARK AT 2225
EAST SHAULIS ROAD FOR CONSTRUCTION OF THE
HOTEL. AND CASINO IN THE CITY OF WATERLOO,
BLACK HAWK COUNTY, IOWA.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve a site plan amendment to the "C-P"
Planned Commercial District for property generally located along
Highway 218, just east of the Lost Island Water Park at 2225 East
Shaulis Road for the construction of the Hotel and Casino,
legally described as follows :
The Southwest of Section 12, Township 88 North, Range
13 West of the 5th Principal Meridian, Black Hawk
County, Iowa .
Also, unplatted Waterloo West that part of the
Northwest of the Southeast 141 of Section 12 Township
88 Range 13 lying within the following described;
commencing at the West corner of said Section 12,
thence South 1315 . 29 feet along the West line of the
Southwest of said Section 12, thence East 60 feet to
the point of beginning, thence continuing East 1260 . 35
feet along an existing fence, thence continuing along
said fence East 1320 . 35 feet, thence continuing along
said fence East 661 . 85 feet to the Westerly right-of-
way line of Relocated Primary Road US Hwy 218, thence
North 43 degrees 25 minutes 30 seconds West 506. 11 feet
along said right-of-way line, thence North 43 degrees
32 minutes 20 seconds West 1034 . 07 feet along said
right-of-way line, thence North 41 degrees 18 minutes
36 seconds West 256. 03 feet along said right-of-way
line to the North line of the Southwest of said
Section 12, thence West 2015. 31 feet along said North
line to the Easterly right-of-way line of Hess Road,
thence South 1315 . 68 feet along said Easterly right-of-
way line to the point of beginning, all in the City of
Waterloo, Black Hawk County, Iowa.
WHEREAS, a public hearing was held on September 19, 2005, at
5 : 30 p.m. , at City Hall Council Chambers, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to approve said above mentioned site plan amendment,
and
WHEREAS, it is the opinion of this Council that said site
plan amendment should be approved with the provision that future
expansion that is labeled on the site plan will be for hotel
expansion only and not for a convention center.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that a site plan amendment to the "C-P"
Planned Commercial District for property generally located along
Highway 218, just east of the Lost Island Water Park at 2225 East
Shaulis Road for the construction of the Hotel and Casino, be and
the same is hereby approved with the provision that future
expansion that is labeled on the site plan will be for hotel
expansion only and not for a convention center.
