RESOLUTION NO. 2005-968 RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE GIVEN UPON THE CITY' S REQUEST TO REZONE FROM "A-1" AGRICULTURAL DISTRICT TO "M- 2, P" PLANNED INDUSTRIAL DISTRICT APPROXIMATELY 14 ACRES OF LAND GENERALLY LOCATED ADJACENT TO 2375 INDEPENDENCE AVENUE, AS NOVEMBER 14, 2005, AT 5: 30 P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF HEARING. WHEREAS, the Council of the City of Waterloo, Iowa, shall meet in the Council Chambers in the City Hall in the City of Waterloo, Iowa, at 5 : 30 p.m. on the 14th day of November, 2005, for the purpose of considering and acting upon the City' s request to rezone from "A-1" Agricultural District to "M-2, P" Planned Industrial District approximately 14 acres of land generally located adjacent to 2375 Independence Avenue and legally described as follows: A parcel of land located in the Southeast Southwest the Northeast Southwest and the Northwest Southeast all in Section 20 Township 89 Range 12 described as follows : Commencing at the Southwest corner of the Southeast 1,1 of said Section 20 thence South 89 Degrees 32 Minutes 32 Seconds West on the South line of the Southwest lei of said Section 20 a distance of 663 . 43 feet to the Southwest corner of the East of the Southeast Southwest of said Section 20 thence Northwest on the West line of the East of the Southeast Southwest of said Section 20 a distance of 1289. 91 feet to the point of beginning of the parcel herein described as the Northwest on the West line of the East of the Southeast Southwest of said Section 20 a distance of 37 . 97 feet to the Northwest corner of the East of the Southeast Southwest of said Section 20 thence Northwest on the West line of the East of the Northeast Southwest of said Section 2.0 a distance of 646. 85 feet to the Southeasterly right-of-way line of the Union Pacific Railroad thence Northeast on the Southeasterly right-of-way line of the Union Pacific Railroad a distance of 78 Degrees 38 Minutes 06 Seconds 93 . 70 feet to the North line of the South of the Northeast Southwest of said Section 20 thence North 89 Degrees 34 Minutes 40 Seconds East on the North line of the South '-� of the Northeast Southwest of said Section 20 a distance of 568 . 51 feet to the Northeast corner of the South of the Northeast Southwest of said Section 20 thence North 89 Degrees 26 Minutes 35 Seconds East on the North line of the South of the Northwest Southeast of said Section 20 a distance of 396. 44 feet thence Southwesterly on a 502 . 96 foot radius curve concave Northwesterly and having a 469 . 69 foot long chord bearing South 37 Degrees 53 Minutes 03 Seconds West a distance of 488 . 69 feet (arc length) thence South 65 Degrees 46 Minutes 38 Seconds West a distance of 828 . 62 feet to the point of beginning, And also; Resolution No. 2005-968 Pagerri 2 V v v J J :v -. - C Cr' That part of Southeast Northeast and that part of l' Northeast Southeast lying Southerly of Southerly lineof -riht-of-way of Chicago Great Western Railroad and Northerly of a line drawn parallel to and 222 . 6 feet v r distant Southerly from said right-of-way line and also the -East 66 feet South % of West Southeast Section 20 Township 89 Range 12 and Easement Book 560 Page 195, -717 all in the City of Waterloo, Black Hawk County, Iowa. NOW,.
