RESOLUTION NO. 2005-974
RESOLUTION GRANTING PERMISSION TO TRAVIS MOEN
FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE
LOCATED AT 3151 BURTON AVENUE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK
ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Travis Moen be authorized and
permitted to construct a concrete driveway and authorizing
construction of a concrete driveway and placing a driveway or
sidewalk on city right-of-way on an unimproved street to be
located at 3151 Burton Avenue, and legally described as follows:
Renners First Addition Part Lot 2 commencing at
Southeast corner of said lot thence West along South
line of said Lot 258 feet thence North along line
parallel with East line of said Lot 164 . 1 feet to point
where said line intersects North line of Lot 2 thence
East along North line of Lot 2 258 feet to Northeast
corner of Lot 2 thence South along East line of Lot 2
to point of beginning subject to easement over the
North 20 feet East 258 feet, all in the City of
Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Travis Moen to construct a concrete driveway
subject to the following conditions:
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
