RESOLUTION NO. 2005-977 RESOLUTION GRANTING PERMISSION TO BUD BALDWIN FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE LOCATED AT 75 E. AIRLINE HIGHWAY, AND AUTHORIZING CONSTRUCTION OF A CONCRETE DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: WHEREAS, the City Engineer has made written application to the City Council asking that Bud Baldwin be authorized and permitted to construct a concrete driveway and authorizing construction of a concrete driveway and placing a driveway or sidewalk on city right-of-way on an unimproved street to be located at 75 E. Airline Highway, and legally described as follows : Unplatted Waterloo East part Southwest Section 1 Township 89 Range 13 described as follows : Commencing at Southwest corner said Southwest thence East along South line said Southwest 369 feet thence North parallel West line said Southwest 44 . 56 feet to Northerly right-of-way line East Airline Highway and point of beginning thence South 84 Degrees 27 Minutes 30 Seconds East 125. 52 feet to point 33 feet normal distant said South line on said Northerly right-of-way I line thence South 89 Degrees 44 Minutes 30 Seconds East along said Northerly right-of-way line 273. 37 feet thence North 329. 92 feet thence West 398 . 30 feet thence South 318 . 36 feet to point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; and WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Bud Baldwin to construct a concrete driveway subject to the following conditions: 1 . Work to be performed by an approved and bonded contractor. 2 . A permit is to be obtained from the office of the City Engineer prior to construction. 3 . All work shall be performed under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
