PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date, time and place above set out. The tentative agenda for said meeting is as follows: • Resolution fixing date for a meeting on the proposal to reallocate certain unspent proceeds of the General Obligation Bonds, Series 2003A and General Obligation Bonds, Series 2004A, of Waterloo, Iowa, and providing for publication of notice thereof Such additional matters as are set forth on the additional 8 page(s) attached hereto. There were present Mayor Tim Hurley , in the chair, and the following named Council Members: Kincaid , Cole, Greenwood, Clark, Schmitt, Gunderson, Welper Absent: none * * * * * * * -1- Council Member Gunderson introduced the following Resolution entitled "RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, SERIES 2003A AND GENERAL OBLIGATION BONDS, SERIES 2004A, OF WATERLOO, IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF", and moved that the same be adopted. Council Member welper seconded the motion to adopt. The roll was called and the vote was, AYES: Kincaid, Cole, Greenwood, Clark, Schmitt, Cun'3Prscn, wp1ppr NAYS: none Whereupon, the Mayor declared the resolution duly adopted as follows: RESOLUTION NO. 2005-1050 RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, SERIES 2003A AND GENERAL OBLIGATION BONDS, SERIES 2004A, OF WATERLOO, IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS, pursuant to a Resolution approved on June 16, 2003, the City Council of the City of Waterloo, Iowa has previously issued its General Obligation Bonds, Series 2003A, in the aggregate principal amount of$8,825,000 (the "Series 2003A Bonds"), for the purpose of paying costs of the reconstruction, extension and improvement of the Waterloo Municipal Airport; the acquisition, development and improvement of GIS/GPS mapping systems and components; the acquisition, construction and improvement of real and personal property useful for the protection of property from floods or high waters, including flood plain alleviation and relocation expenditures; the construction, reconstruction and repairing of street, sidewalk and intersection improvements; the acquisition of vehicles and equipment for the police, fire and street departments; the rehabilitation and improvement of City parks and the acquisition, repair and replacement of facilities, equipment and improvements commonly found in City parks; and the acquisition, improvement and installation of traffic control devices and street lighting -2- fixtures; the aiding in the planning, undertaking and carrying out of urban renewal project activities under Chapter 403 of the Code of Iowa, as amended, and the Urban Renewal Plans for the Downtown Waterloo Riverfront Urban Renewal Area, the Airport Tax Increment Redevelopment Area and the Rath Tax Increment Redevelopment Area, including the acquisition of properties, and related demolition and clearance activities, for subsequent private redevelopment and the construction of public improvements within such areas; the reconstruction and improvement of the Five Sullivan Brothers Center; the reconstruction, remodeling, repair and improvement of City buildings; and the acquisition of hardware and software and related computer replacement program expenditures; the acquisition of capital equipment and vehicles for City departments and operations; and the reconstruction and improvement of the Youth Pavilion, Riverfront Stadium and sports and boating center facilities; the reconstruction and improvement of City golf courses; and the acquisition of golf and parks equipment; the funding of the City's obligations under an economic development guaranty agreement relating to expanded regional jet service at the Waterloo Municipal Airport; the refunding and refinancing of certain City indebtedness, consisting of the outstanding General Obligation Bonds, Series 1995, dated June 1, 1995; and construction and acquisition of sanitary sewer and wastewater treatment plant improvements and related facilities, including those costs associated with the replacement and installation of sanitary sewer liners and other corrosion and odor control improvements; and WHEREAS, pursuant to a Resolution approved on June 14, 2004, the City Council of the City of Waterloo, Iowa has previously issued its General Obligation Bonds, Series 2004A, in the aggregate principal amount of$9,745,000 (the "Series 2004A Bonds"), for the purpose of paying costs of the acquisition, construction and improvement of real and personal property useful for the protection of property from floods or high waters, including flood plain alleviation and relocation expenditures and tributary improvements; the construction, reconstruction and repairing of street, sidewalk and intersection improvements; the acquisition, construction and installation of storm sewer improvements, bikeway development and related trail signage; the acquisition of vehicles and equipment for the police, fire rescue and street departments; the rehabilitation and improvement of City parks and the acquisition, repair and replacement of facilities, equipment and improvements commonly found in City parks; and the acquisition, improvement and installation of traffic control devices, early warning sirens and street lighting fixtures; the aiding in the planning, undertaking and carrying out of urban renewal project activities under Chapter 403 of the Code of Iowa, as amended, and the Urban Renewal Plans for the Downtown Waterloo Riverfront Urban Renewal Area, the Airport Tax Increment Redevelopment Area and the Rath Tax Increment Redevelopment Area, including the acquisition of properties, and related demolition and clearance activities, for subsequent private redevelopment and the construction of public -3- improvements within such areas; the reconstruction, improvement and repairing of the Five Sullivan Brothers Center, Young Arena and its parking area, Youth Pavilion, Center for the Arts, and the roofs of various City buildings and facilities; the reconstruction, remodeling, repair and improvement of various City buildings and facilities; and the acquisition of hardware and software and related computer replacement program expenditures; the acquisition of capital equipment and vehicles for various City departments and operations; the reconstruction and improvement of City golf courses; and the reconstruction, renovation and improvement of the Riverfront Stadium, swimming pools and sports and boating center facilities; construction and acquisition of sanitary sewer improvements and related facilities, including those costs associated with the Garden Avenue Relief Sewer project; and the refunding and refinancing of City indebtedness, including the outstanding General Obligation Bonds, Series 1996, dated June 1, 1996 and General Obligation Bonds, Series 1997, dated June 1, 1997; and WHEREAS, certain proceeds of the Series 2003A Bonds and the Series 2004A Bonds remain unspent, and City staff has recommended that not to exceed $200,000 of the interest earnings on such unspent proceeds (hereinafter referred to as the "Unspent Proceeds") be applied for the purpose of defraying all or a portion of the costs of constructing restroom facilities and a ticket booth at Riverfront Stadium; and WHEREAS, there being no procedure specified under Iowa law for consideration or approval of such a reallocation, it is hereby determined, pursuant to Section 364.6 of the Code of Iowa, that the procedure set forth in Section 384.25 should apply and that a hearing be held upon the proposal to reallocate the Unspent Proceeds to provide funds for constructing restroom facilities and a ticket booth at Riverfront Stadium. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That this Council meet in the Council Chambers, City Hall, Waterloo, Iowa, at 5: 30 o'clock P.M., on the 12th day of December , 2005 , for the purpose of taking action on the matter of the proposed reallocation of the Unspent Proceeds of the Series 2003A Bonds and Series 2004A Bonds to provide funds for constructing restroom facilities and a ticket booth at Riverfront Stadium. Section 2. That the City Clerk is hereby directed to cause one publication to be made of notice of said meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in said City, said publication to be not less than four clear days nor more than twenty days before the date of said public meeting. -4- Section 3. The notice of the proposed action shall be in substantially the following form: -5- NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, ON THE MATTER OF THE PROPOSED REALLOCATION OF CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, SERIES 2003A AND GENERAL OBLIGATION BONDS, SERIES 2004A, OF THE CITY OF WATERLOO, IOWA, AND THE PUBLIC HEARING THEREON PUBLIC NOTICE is hereby given that the Council of the City of Waterloo, Iowa, will hold a public hearing on the 12th day of December , 2005, at 5 : 30 o'clock P .M., in the Council Chambers, City Hall, Waterloo, Iowa, at which meeting the Council proposes to take additional action for the reallocation of certain interest earnings on the unspent proceeds of the General Obligation Bonds, Series 2003A (the "Series 2003A Bonds") and General Obligation Bonds, Series 2004A (the "Series 2004A Bonds") of the City of Waterloo, Iowa, in the aggregate amount of not to exceed $200,000, in order to provide funds to pay costs of constructing restroom facilities and a ticket booth at Riverfront Stadium. Any person interested may appear at the public hearing, either orally or in writing, and be heard as to the reallocation of said proceeds of the Series 2003A Bonds and Series 2004A Bonds for the above purposes. This Notice is given by order of the Council of Waterloo, Iowa, as provided by Sections 364.6 and 384.25 of the Code of Iowa, 2005, as amended. Dated this 21st day of November , 2005.
