RESOLUTION NO. 2005-1105
RESOLUTION APPROVING REAL ESTATE CONTRACT WITH
CHICAGO, CENTRAL & PACIFIC RAILROAD COMPANY
AND DIRECTING EXECUTION OF SAID CONTRACT BY
MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Real Estate Contract dated December 12, 2005, to
purchase approximately 1 . 83 acres of former railroad right-of-
way, at a cost of $43, 761 . 30, as part of the Rath Area
Development, by and between Chicago, Central & Pacific Railroad
Company and the City of Waterloo, Iowa, be and the same is hereby
approved, and the Mayor authorized to execute the same in behalf
of the City of Waterloo, Iowa for the following described
property:
A parcel of land located in part of Beltline Railway in
Riverside Addition, and part of Lots 9 and 10 in Block
14 of Lane & Fowlers Second Addition, and part of Lots
2, 3, 4, 5 and 6 in Block 13 of Lane & Fowlers Second
Addition, and part of the vacated alley in Block 13 of
Lane & Fowlers Second Addition, all in the City of
Waterloo, County of Black Hawk, State of Iowa, more
particularly described as follows :
Commencing at the Northeast corner of Lot 1 in Block 13
of Lane & Fowlers Second Addition; thence South 89°
(Degrees) 54' (Minutes) 57" (Seconds) West (assumed
bearing for the purpose of this description) on the
North line of Lots 1 and 2 in Block 13 of Lane &
Fowlers Second Addition, also being the present South
right-of-way line of Mulberry Street, 109 . 58 feet to
the point of beginning of the parcel herein described;
thence South 33°26' 58" West, 290 . 38 feet; thence
Southwesterly on the Southeasterly line of said
Beltline Railway and its extension Northeasterly, also
being the Northwesterly line of Lots 1, 2 and 3 in
Block 3 of Riverside Addition, and Lot 1 in Cowin' s
Subdivision in Riverside Addition being a 1, 183 . 78-foot
radius curve concave Northwesterly and having a
1, 009. 66-foot long chord bearing South 58°41' 33" West,
1, 043 . 08 feet (arc length) to the Westerly corner of
Lot 1 in Cowin' s Subdivision in Riverside Addition;
thence North 64 °23' 58" West, 129. 38 feet to the
Southerly line of Lot 4 of Auditor' s Consolidated Plat,
also being the Northwesterly line of said Beltline
Railway; thence Northeasterly on the Southerly line of
Lot 4 of Auditor' s Consolidated Plat, also being the
Northwesterly line of said Beltline Railway, being a
1, 121 . 28-foot radius curve concave Northerly and having
a 70 . 62-foot long chord bearing North 87 °46' O1" East,
70 . 73 feet (arc length) to the East line of Lot 4 of
Auditor' s Consolidated Plat; thence North 01°00' 00"
West on the East line of Lot 4 of Auditor' s
Consolidated Plat, also being the Northwesterly line of
said Beltline Railway, 12 . 52 feet to the Southwesterly
corner of Lot 4 in Block 7 of Riverside Addition;
thence Northeasterly on the Southeasterly line of Lots
4, 3, 2, and 1 in Block 7 of Riverside Addition, and
Lots 7 and 1 in Block 2 of Riverside Addition, also
being the Northwesterly line of said Beltline Railway
and its extension Northeasterly, being a 1, 108 . 78-foot
