RESOLUTION NO. 2005-1124 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF THE EXISTING PARKING LOT BOUNDED BY EAST 6TH STREET, LAFAYETTE STREET AND SYCAMORE STREET FOR $70, 000 . 00, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME AND RESCINDING RESOLUTION NO. 2005-630 IN ITS ENTIRETY. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $70, 000 . 00, has been made by Black Hawk County, and WHEREAS, a public hearing was held on December 19, 2005, at 5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Black Hawk County, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on December 9, 2005, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Black Hawk County to purchase real property for the sum of $70, 000 . 00, be and it is hereby accepted for real property described below: This Plat represents a survey of Parcel "K" That part of the Lots Nos . 2 and 3 in Block No. 16, Original Plat of Waterloo (East Side) , in the City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the most Northerly corner of said Block No. 16, point being a found "mag" nail in A. C. C. pavement; thence South 4 9°4 9'-�' East along the Northeasterly line of said Block No. 16 a distance of 110 . 9 feet to a point being 25 . 0 feet distant Northwesterly, measured at right angles, from the centerline of the main track of the Union Pacific Railroad (formerly the Chicago and North Western Transportation Company, formerly the Chicago Great Western Railway Company) , point being a found " rebar with license #16264 ; thence continuing South 40°06' West parallel with said centerline a distance of 115 . 0 feet to a set "mag" nail in A. C. C. pavement; thence North 49°49 ' West a distance of 110 . 7 feet to the Northwesterly line of said Block No. 16; Resolution 2005-1124 Page 2 thence North 39°584' East along said Northwesterly line a distance of 115 . 0 feet to the point of beginning. This Plat represents a survey of Parcel "L" That part of Lots Nos . 6, 7 and 10 in Block No. 16, Original Plat of Waterloo (East Side) , in the City of Waterloo, Black Hawk County, Iowa, described as follows : Commencing at the most Northerly corner of said Block No. 16, point being a found "mag" nail in A. C. C. pavement; thence South 39°584' West along the Northwesterly line of said Block No. 16 a distance of 115 . 0 feet to the point of beginning; thence South 49°494' East a distance of 110 . 7 feet to a point being 25 . 0 feet distant Northwesterly, measured at right angles, from the centerline of the main track of the Union Pacific Railroad (formerly the Chicago and North Western Transportation Company, formerly the Chicago Great Western Railway Company) , point being a set "mag" nail in A. C. C. pavement; thence South 40°06' West along parallel with said centerline a distance of 186 . 2 feet to the Southwesterly line of said Block No. 16, point being a found "V" cut on the Northeasterly edge of P. C. C. sidewalk; thence North 49°47' West along said Southwesterly line a distance of 110 . 3 feet to the most Westerly corner of said Block No. 16, point being a found "mag" nail in A. C. C. pavement; thence North 39°584' East along the Northwesterly line of said Block No. 16 a distance of 186 . 1 feet to the point of beginning. Contains 20, 565 ft', all in the City of Waterloo, Black Hawk County, Iowa . Subject to easements of record and not of record. Note : Bearings are assumed. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Black Hawk County by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Black Hawk County. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Black Hawk County upon receipt of the sum of $70, 000 . 00 .
