Acceptance of, or purchase from, a Sales Agreement corresponding to this bid document will be construed as acceptance of this testing process and/or any other Flint Hills Resources, LP change, modification, or deletion contained herein. For clarification, Flint Hills Resources, LP (FHR) cannot comply with the MEASUREMENT section out lined in the Specifications and Bid Proposal for Asphalt Emulsions. It reads as follows: "Each Toad shall be delivered with a producer's scale ticket showing gross, tare, and net wights converted to net gallons." Instead of a scale ticket, FHR will provide a bill of lading with each Toad that will show gross weight, tare weight and net tons on board. In addition, the BOL will list a typical weight per gallon for reference. All product orders should be made at least 24 hours in advance. This quote is good for3 days from the date above unless otherwise noted from FHR and is subject to any other conditions listed below. All sales require a valid line of credit be established with FHR. Additional Considerations: 1. Quote is good until City of Waterloo, IA awards 2021 work. 2. FHR will bill and invoice using the per ton price stated on this quote letter. 3. The City may request placement of storage unit from tanker. which to load into distributor. Individual loads may be directed to the actual work site with the corporate limits of Waterloo for off-loading at that location. A total off-loading allowance of not to exceed four (4) hours from the requested delivery time shall be allowed. Any trucking or demurrage for this four-hour, off-loading time shall be included in the unit price for the products. Delivery shall be made by standard semi -tractor tanker load. Deliveries will normally be requested between 7:00am and 3:OOpm, Monday through Friday. Delivery tirne upon receipt of a call for delivery shall not exceed 72 hours. D.
