RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION, SALE AND CONVEYANCE OF A SMALL
STREET PORTION GENERALLY LOCATED WEST OF
JOHNATHAN STREET BETWEEN WEST SAN MARNAN
DRIVE AND TOWER PARK DRIVE, CONTAINING
APPROXIMATELY 4 , 108 . 8 SQ. FT. , TO LOCKARD
DEVELOPMENT FOR $1 . 00, PLUS COSTS, AS JULY 6,
2004 , AT 5 : 30 P.M. IN CITY HALL COUNCIL
CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE
CITY CLERK TO PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa,
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 5 : 30 p.m. on the 6th day of July, 2004 , for the purpose
of considering and acting upon a proposal to vacate, sell and
convey a small street portion generally located west of Johnathan
Street between West San Marnan Drive and Tower Park Drive,
containing approximately 4 , 108 . 8 sq. ft . to Lockard Development,
and legally described as follows :
A part of the Northeast 1/ of Section 9-88-13 , Waterloo,
Black Hawk County, Iowa, described as follows :
Commencing at the Northeast corner of the Northwest 1/
of the Northeast 1/ of said Section 9; thence South
00°26 ' 14" East along the East line of the Northwest 1/
of the Northeast 1/ of said Section 9 a distance of
63 . 43 feet to the Southerly right-of-way line of West
San Marnan Drive; thence North 89°03 ' 48" West along
said right-of-way line a distance of 40 . 01 feet to the
Westerly right-of-way line of Johnathan Street; thence
South 00°26' 14" East along said Westerly right-of-way
line a distance of 10 . 27 feet; thence Southeasterly
along said Westerly right-of-way line on a curve
concave Northeasterly having a radius of 230 . 00 feet
and a long chord bearing South 21°10' 56" East a
distance of 166 . 56 feet to the point of beginning;
thence Southeasterly along said right-of-way line along
a curve concave Northeasterly, having a radius of
230 . 00 feet and a long chord bearing South 43°41' 08"
East a distance of 14 . 06 feet; thence South 45°26' 14"
East along said right-of-way line a distance of 75 . 04
feet ; thence Westerly along a curve concave Southerly,
having a radius of 15 . 00 feet and a long chord bearing

South 44°33 ' 46" West a distance of 29 . 56 feet; thence
Southwesterly along a curve concave Northwesterly
having a radius of 210 . 00 feet and a long chord bearing

East line of the Northwest 1/ of the Northeast 1/ of said
Section 9 ; thence North 00°26' 14" West along said East
line of the Northwest 1/ of the Northeast % a distance

of 24 . 16 feet; thence Northeasterly along a curve
