RESOLUTION NO. 2004-358
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF DISPOSAL PARCELS ACQUIRED AS
PART OF THE MARTIN LUTHER KING JR. DRIVE
PROJECT FOR $3 , 250 . 00 PER ACRE FROM WILLARD
FROST, PLUS COSTS, AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AND DELIVER A DEED
FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $3 , 250 . 00 per acre, plus costs, has been
made by Willard Frost, and
WHEREAS, a public hearing was held on June 7, 2004, at 5 :30
p.m. in the Council Chambers in City Hall , Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Willard Frost, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on May
24 , 2004 , is not presently needed and will not be needed in the
foreseeable future for municipal purposes and its ownership is
serving no municipal purpose, and
2 . That the offer of Willard Frost to purchase real
property for the sum of $3 , 250 . 00 per acre, and costs be, and it
is hereby accepted for real property described below:
A parcel of land located in the Southeast 1/ of the
Northeast % and the Northeast 1/ of the Southeast 1/ of
Section 20, Township 89 North, Range 12 West of the
Fifth Principal Meridian, in the City of Waterloo,
Black Hawk County, Iowa, more particularly described as
follows :
Commencing at the Northeast corner of said Section 20;
thence South 89°34 ' 19" West on the North line of the
Northeast 1/ of said Section 20 a distance of 330 . 00
feet; thence South 01°00' 40" East parallel with the
East line of the Northeast 1/ of said Section 20 a
distance of 2 , 314 . 70 feet to the present Southerly
right-of-way line of Martin Luther King Jr. Drive, the
point of beginning of the parcel herein described;
thence continuing South 01°00' 40" East a distance of
64 . 34 feet to the present. North line of the Union
Pacific Railroad; thence South 69°34' .17" West on the
present North line of the Union Pacific Railroad a
distance of 1, 045 . 80 feet to the West line of the
Northeast VI of the Southeast 1/4 of said Section 20;
thence North 01°07' 06" West. on the West line of the
Northeast % of the Southeast % of said Section 20 a
distance of 85 . 59 feet to the Southwest corner of the

real property to Willard Frost by Deed.
E." 4 . =- That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to Willard Frost .
5 . That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council .
6 . That the City Clerk is authorized and directed to
deliver said deed of conveyance to Willard Frost upon receipt of
the sum of $3 , 250 . 00 per acre, and costs .
PASSED AND ADOPTED this 7th day of June, 2004 .
