s RESOLUTION TO APPOINT SPECIAL LEGAL COUNSEL

o br WHEREAS, an employee of the Waterloo Street Department, while
ip the performance of his duties operating a snowplow, was involved
c!,, i41, an accident resulting in the death of a pedestrian; and
`-' WHEREAS, the
police chief has asked the city attorney to
review the incident and consult with him regarding the Waterloo
Tffic Code; and
WHEREAS, the city attorney believes it would be a conflict of
interest for him or his office to advise the
police
m`4ter and has recommended the appointment of independent special
coiznsel ; and
WHEREAS, the law firm of Yagla, McCoy & Riley has indicated
its willingness to serve as special counsel .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the law firm of Yagla, McCoy & Riley is
engaged to review the above-described incident and consult with the
police chief.
BE IT FURTHER RESOLVED that the City of Waterloo shall
compensate the law firm of Yagla, McCoy, and Riley for its services
as special counsel at the rate of $100 . 00 per hour for attorney
time, plus reasonable out-of-pocket expenses .
PASSED AND ADOPTED this 26th day of April, 2004 .
