RESOLUTION NO. 2004-206
RESOLUTION GRANTING PERMISSION TO STEVEN
VOGEL FOR A WAIVER FOR A CONCRETE DRIVEWAY TO
BE LOCATED AT 1709 BUTLER AVENUE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY ON CITY RIGHT-OF-WAY ON AN
UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Steven Vogel be authorized and
permitted to construct a concrete driveway on City right-of-way
on an unimproved street to be located at 1709 Butler Avenue, and
legally described as follows :
A part of Southwest 1/ Northeast 14 Section 29 Township
89 Range 12 described as beginning at a point which is
685 feet East and 357 . 6 feet North of center of Section
29 thence North 93 feet thence South 89 degrees 27
minutes 43 seconds East 150 feet thence South 93 feet
thence North 89 degrees 27 minutes 44 seconds West
150 . 11 feet to point of beginning, all in the City of
Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Steven Vogel to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this 12th day of April , 2004 .
