RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON A
DEVELOPMENT AGREEMENT WITH FERGUSON
ENTERPRISES, INC. TO BUILD A 608, 800 SQUARE
FOOT DISTRIBUTION CENTER GENERALLY LOCATED
WESTERLY OF THE NORTHWEST CORNER OF
INDEPENDENCE AVENUE AND NORTH ELK RUN ROAD
AND SOUTHERLY OF MARTIN LUTHER KING JR.
DRIVE, AS APRIL 19, 2004 AT 5 : 30 P.M. IN CITY
HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 19th day of April, 2004 for the purpose
of considering and acting upon a Development Agreement with
Ferguson Enterprises, Inc . to build a 608, 800 square foot
distribution center generally located westerly of the northwest
corner of Independence Avenue and North Elk Run Road and
southerly of Martin Luther King Jr. Drive, with a taxable value
of $19, 000 , 000 . 00, with the city making a grant for the purchase
price of the land estimated at $2 , 433 , 500 . 00 , and $600, 000 . 00 for
grading the property, with 50 percent tax rebates for ten years,
construction of a railroad spur if needed and installation of
various utilities to the site at no cost to the company, and
legally described as follows :
Parcel "B" of Plat of Survey Document #2004-02509 as
described as follows : That part of the West half of
the Southeast quarter (W SE 1/) of Section No. 21,
Township No. 89 North, Range No. 12 West of the Fifth
Principal Meridian, Black Hawk County, Iowa, described
as follows :
Commencing at the Southwest corner of the Southeast 1/
of said Section No. 21, point being a found "mag" nail
in A.C.C. pavement; thence due East along the South
line of said Southeast quarter a distance of 499 . 8 feet
to the point of beginning, being a set "mag" nail in
A. C. C. pavement; thence due North a distance of 369 . 0
feet to a set " rebar with license #6505; thence due
East a distance of 195 . 0 feet to a set %" rebar with
license #6505; thence due South a distance of 369 . 0
feet to the South line of said Southeast quarter, point
being a set "mag" nail in A.C.C. pavement; thence due
West along said South line a distance of 195 . 0 feet to
the point of beginning.
Containing 1 . 65 acres including 0 . 15 acre of right-of-
way. Subject to easements of record and not of record.
The South line of the Southeast quarter of said Section
No. 21 is assumed to bear due East for this
description, all in the City of Waterloo, Black Hawk
County, Iowa;

The above parcel of land is the same lands conveyed by
the estate of Audrie B. King, deceased, to the Willard
R. Frost Trust by Court Order Deed, recorded in Fee
Book 2004-15274 , in the Black Hawk County Recorder' s
office, all in the City of Waterloo, Black Hawk County,
Iowa;
And also,
The East of the Southwest % of Section 21, Township
89 North, Range 12 West of the 5th Principal Meridian,
City of Waterloo, County of Black Hawk, State of Iowa;
excepting that part conveyed to the City of Waterloo,
Iowa, for Martin Luther King, Jr. Drive, recorded in
Land Deed Book 572 Page 648 in the Black Hawk County
Recorder' s office . Subject to easements of record.
Containing 72 . 52 acres including 1 . 0 acre of right-of-
way for Independence Avenue, all in the City of
Waterloo, Black Hawk County, Iowa.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
