RESOLUTION NO. 2004-225 PESOLUTION TO ESTABLISH THE AMOUNT OF JUST COMPENSATION FOR CERTAIN PROPERTIES TO BE ACQUIRED IN THE RATH NEIGHBORHOOD AREA AND TO AUTHORIZE THE USE OF CONDEMNATION PROCEDURES FOR ACQUISITION OF SAID PROPERTIES IN THE RATH NEIGHBORHOOD AREA IN FURTHERANCE OF THE OBJECTIVES OF THE RATH NEIGHBORHOOD REVITALIZATION MASTER PLAN. WHEREAS, by Resolution No. 1999-477 adopted on July 19, 1999, the City Council of the City of Waterloo approved a project (the "Project" ) to acquire underutilized and dilapidated properties in the Rath Neighborhood area for redevelopment in accordance with the Rath Neighborhood Revitalization Master Plan (the "Plan" ) , and by Resolution No. 2003-581 adopted on September 2 , 2003 the City Council amended the Plan to include the area in which the Properties (defined below) are located; and WHEREAS, in executive session on December 1, 2003 , the City Council of the City of Waterloo discussed and reviewed appraisals for certain properties in the Project area, namely, parcel nos . 8913-25-258-002 , 8913-25-258-003 , 8913-25-258-004 , 8913-25-258-005, and 8913-25-259-001 (collectively, the "Properties" ) , and determined that - the appraisals represented the fair market value of the Properties; and WHEREAS, on December 1, 2003 , the City Council of the City of Waterloo approved by motion the use of the condemnation process under Iowa law to acquire the Properties by eminent domain; and WHEREAS, the City Council of the City of Waterloo desires to ratify the above-described actions taken in executive session and by motion and to spread them upon the public record by this resolution.
