RESOLUTION NO. 2004-119
RESOLUTION APPROVING SITE PLAN AMENDMENT TO
THE "C-Z" CONDITIONAL ZONING FOR PROPERTY
GENERALLY LOCATED AT THE NORTHWEST CORNER OF
EAST 4TH AND DONALD STREETS, IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve a site plan amendment to the "C-Z"
Conditional Zoning for property generally located at the
northwest corner of East 4 h and Donald Streets for the purpose
of retirement housing development consisting of 39 units on 2 . 76
acres and legally described as follows :
That part of the Southwest 4 of the Southwest /,
Section 12-89-13 , City of Waterloo, Black Hawk County,
Iowa, described as follows :
Commencing at the Southeast corner of the said
Southwest 1/ of the Southwest 1/; thence North 00°00 ' 00"
East along the East line of said Southwest % of the
Southwest 1/ a distance of 33 . 00 feet; thence North
89°00 ' 51" West a distance of 33 . 00 feet to the point of
beginning which is the intersection of the Westerly
right-of-way line of East Fourth Street and the
Northerly right-of-way line of Donald Street; thence
North 89°00 ' 51" West along said Northerly right-of-way
line a distance of 445 . 61 feet; thence North 00°06' 00"
East a distance of 270 . 00 feet; thence South 89°00' 51"
East a distance of 445 . 14 feet ; thence to the Westerly
right-of-way line of East Fourth Street; thence South
00°00 ' 00" West along said Westerly right-of-way line a
distance of 270 . 00 feet to the point of beginning.
The East line of the Southwest 1/ of the Southwest %,
Section 12-89-13 is assumed to bear South 00°00' 00"
West, all in the City of Waterloo, Black Hawk County,
Iowa.
WHEREAS, a public hearing was held on March 15, 2004 , at
5 : 30 p.m. , at City Hall Council Chambers, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to approve said above mentioned site plan amendment,
and
WHEREAS, it is the opinion of this Council that said site
plan amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that a site plan amendment to the "C-Z"
Conditional Zoning for property generally located at the
northwest corner of East 4th and Donald Streets for the purpose
of retirement housing development consisting of 39 units on 2 . 76
