RESOLUTION NO. 2004-62 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE OF PROPERTY GENERALLY DESCRIBED AS SAN MARNAN DRIVE RIGHT-OF-WAY IN FRONT OF LOTS 2 AND 3 , ANDERSON' S SIXTH ADDITION, TO J & S FAMILY REALTY, LLC AS FEBRUARY 23 , 2004 , AT 5 : 30 P .M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : Section 1 . That the Council of the City of Waterloo, Iowa, shall meet at City Hall Council Chambers in the City of Waterloo, Iowa, at 5 : 30 p .m. on the 23rd day of February, 2004 , for the purpose of considering and acting upon a proposal to vacate, sell and convey property generally described as San Marnan Drive right-of-way in front of Lots 2 and 3 , Anderson' s Sixth Addition to J & S Family Realty, LLC, and legally described as follows : That part of East San Marnan Drive lying North of and adjacent to Lot 2 , Anderson' s Sixth Addition, Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northwest corner of said Lot 2 ; thence North 0l°17' 54 East a distance of 50 . 00 feet ; thence South 88°43 ' 24" East a distance of 389 .46 feet ; thence South 01°15' 28" West a distance of 50 . 00 feet to the Northeast corner of said Lot 2 ; thence North 88°43 ' 24" West along the North line of said Lot 2 a distance of 385 . 50 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa, subject to the city' s retention of drainage and utilities easements over, under and above the above described property. The North line of Lot 2 is assume to bear North 88°43 ' 24" West ; and also; That part of East San Marnan Drive lying North of and adjacent to Lot 3 , Anderson' s Sixth Addition, Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northwest corner of said Lot 3 ; thence North 01°15' 27" East a distance of 40 . 00 feet; thence South 88°43 ' 24" East a distance of 305 . 08 feet; thence South 01°17' 47" West a distance of 40 . 00 feet to the Northeast corner of said Lot 3 ; thence North 88°43 ' 24" West along the North line of said Lot 3 a distance of 305 . 07 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa, subject to the city' s retention of drainage and utilities easements over, under and above the above described property. The North line of Lot 3 is assumed to bear North 88°43 ' 24" West; for $1 . 00 , plus costs .
