RESOLUTION NO. 2004-31
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A PORTION OF CITY RIGHT-OF-WAY
GENERALLY DESCRIBED AS THE PORTION OF FORMER
SOUTH HACKETT DRIVE, SOUTH OF YOUNG PLUMBING
AND HEATING AND NORTH OF GREENHILL ROAD AS
FEBRUARY 9, 2004 , AT 5 : 30 P.M. IN CITY HALL
COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 9th day of February, 2004 , for the
purpose of considering and acting upon a proposal to vacate a
portion of city right-of-way generally described as the portion
of former South Hackett Drive, south of Young Plumbing and
Heating and north of Greenhill Road, and legally described as
follows :
That part of the Southeast Quarter of the Southeast
Quarter (SE1/ SE'%) of Section 20, and that part of the
Southwest Quarter (SW%) of Section 21, all in Township
89 North, Range 13 West of the Fifth Principal
Meridian, City of Waterloo, Black Hawk County, Iowa,
described as follows :
Commencing at the Southeast corner of said Southeast
Quarter of the Southeast Quarter, point being a found
rebar with license #8033 ; thence North 00°00' 45"
West along the East line of said Southeast Quarter of
the Southeast Quarter a distance of 721 . 9 feet
(recorded as 722 .44 feet) to the Northeast corner of
the South 722 .44 feet of the East 281 . 5 feet of said
Southeast Quarter of the Southeast Quarter; thence
North 89°01' West along the North line of said South
722 .44 feet a distance of 50 . 0 feet to the Northeast
corner of the South 722 .44 feet of the West 231 . 5 feet
of the East 281 . 5 feet of said Southeast Quarter of the
Southeast Quarter, being the point of beginning and a
found W" rebar with license #6505; thence South 89°01'
East a distance of 42 . 0 feet to a set W" rebar with
license #6505; thence South 00°00' 30" East a distance
of 19 . 3 feet to a set W" rebar with license #6505;
thence Southeasterly 123 . 0 feet along a curve concave
Northeasterly having a radius of 107 . 19 feet, a central
angle of 65°45' 15" and a long chord of South 32°53 '
East 116 . 4 feet to a found %" rebar with license #6505;
thence Easterly 77 .46 feet along a curve concave
Northerly having a radius of 99 . 19 feet, a central
angle of 44°44 ' 45" and a long chord of South 88°08'
East 75 . 5 feet to a found W" rebar with license #6505;
thence North 69°33 ' 15" East a distance of 96 . 2 feet to
