RESOLUTION NO. 2004-536
RESOLUTION GRANTING PERMISSION TO PHIL BAILEY
FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE
LOCATED AT 1231 GARDEN AVENUE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Phil Bailey be authorized and
permitted to construct a concrete driveway with the elimination
of the sidewalk section due to the inability to meet requirements
of the driveway and sidewalk policy, paragraph 1, to be located
at 1231 Garden Avenue, and legally described as follows :
Meadowdale second filing part of Lot 48 beginning at a
point on South line Garden Avenue 132 feet East of
Northwest corner thence Southeast on South line Garden
Avenue 66 . 11 feet to an angle point in South line
Garden Avenue thence Southwest 109 . 7 feet to an angle
point in Northwest line Black Hawk Road thence
Southwest along Northwest line Black Hawk Road 32 . 9
feet to a point on a line 125 feet from and parallel
South line Garden Avenue thence Northwest 24 . 15 feet on
said line to a point 108 feet from West line Lot 48
thence Northeasterly 127 .2 feet to beginning except
that part deeded to City of Waterloo Book 595 Page 785,
all in the City of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Phil Bailey to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
