< RESOLUTION ORDERING THE CONSTRUCTION OF THE

o F.Y. 2005 SIDEWALK REPAIR ASSESSMENT PROGRAM
- ZONE 4 , CONTRACT NO. 679 .

o nr71 WHEREAS, by Resolution No. 2004-542 , plans, specifications,
for the F.Y. 2005 Sidewalk Repair Assessment Program - Zone
known as Contract No. 679, in the City of Waterloo, Iowa, have
w ?gin approved and adopted by this Council after the hearing
;prescribed by statute .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that it is deemed advisable and necessary and it
is" so ordered on motion by this Council that the said
improvements be constructed in accordance with said plans and
pecifications .
tr R That the work herein ordered is to be paid in monthly
,es .imates, in cash, on the basis of 90 percent of the work as the
same is completed and materials delivered and the work approved,
except that before the last month' s payment is made the
contractor may be required to furnish the City Council vouchers
showing that all subcontractors and workmen and persons
furnishing materials have been fully paid for such materials and
labor, and that the City may retain the last month' s payment for
a period of 31 days following such completion and approval,
unless satisfied that materials, men and laborers have been paid.
That said work shall be done by contract and shall be
commenced promptly after receipt of "Notice to Proceed" .
PASSED AND ADOPTED this 16th day of August, 2004 .
