RESOLUTION NO. 2004-562
RESOLUTION APPROVING SITE PLAN AMENDMENT TO
THE "R-P" PLANNED RESIDENCE DISTRICT AND "C-P"
PLANNED COMMERCIAL DISTRICT FOR SCHENK
ENGINEERING ON BEHALF OF CEDAR VALLEY MEDICAL
FOR PROPERTY GENERALLY LOCATED JUST WEST OF
THE LINCOLN SAVINGS BANK AT 242 TOWER PARK
DRIVE FOR THE PURPOSE OF DEVELOPMENT OF A
MEDICAL IMAGING OFFICE FACILITY IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve a site plan amendment to the "R-P"
Planned Residence District and "C-P" Planned Commercial District
for Schenk Engineering on behalf of Cedar Valley Medical for
property generally located just west of the Lincoln Savings Bank
at 242 Tower Park Drive for the purpose of development of a
medical imaging office facility, and legally described as
follows :
Parcel E
A part of the Northeast 1/ of Section 9-88-13 , Waterloo,
Black Hawk County, Iowa, described as follows :
Commencing at the Northeast corner of the Northwest. 1/
of the Northeast 1/ of said Section 9; thence South
00°26' 14" East along the East line of the Northwest 1%
of the Northeast % of said Section 9 a distance of
63 .43 feet to the Southerly right-of-way line of W. San
Marnan Drive; thence North 89°03 ' 48" West along said
right-of-way line a distance of 40 . 01 feet to the
Westerly right-of-way line of Johnathan Street; thence
South 00°26' 14" East along said Westerly right-of-way
line a distance of 10 .27 feet ; thence Southeasterly
along said Westerly right-of-way line on a curve
concave Northeasterly having a radius of 230 . 00 feet
and a long chord bearing South 17°35' 27" East a
distance of 137 . 71 feet to the point of beginning;
thence Southeasterly along said right-of-way line on a
curve concave Northeasterly, having a radius of 230 . 00
feet and a long chord bearing South 40°05' 27" East a
distance of 42 . 91 feet; thence South 45°26' 14" East
along said right-of-way line a distance of 114 . 17 feet ;
thence North 89°03 ' 48" West a distance of 108 . 12 feet
to the East line of the Northwest 14 of the Northeast
of said Section 9; thence North 00°26' 14" West along
the East line of the Northwest % of the Northeast 1% of
said Section 9 a distance of 111 . 14 feet to the point
of beginning.
The East line of the Northwest 14 of the Northeast 1/ of
said Section 9 is assumed to bear South 00°26' 14" East,
all in the City of Waterloo, Black Hawk County, Iowa.

The East line of the Northwest % of the Northeast 4 of
said Section 9 is assumed to bear South 00°26' 14" East,
all in the City of Waterloo, Black Hawk County, Iowa.
WHEREAS, a public hearing was held on August 23 , 2004 , at
5 : 30 p.m. , at City Hall Council Chambers, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to approve said above mentioned site plan amendment,
and
WHEREAS, it is the opinion of this Council that said site
plan amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that a site plan amendment to the "R-P"
Planned Residence District and "C-P" Planned Commercial District
for Schenk Engineering on behalf of Cedar Valley Medical for
property generally located just west of the Lincoln Savings Bank
at 242 Tower Park Drive for the purpose of development of a
medical imaging office facility, be and the same is hereby
approved.
PASSED AND ADOPTED this 23rd day of August, 2004, and
approved by the Mayor this 25th day of August, 2004 .
