RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF NORM
HAYEK TO REZONE FROM "A-1" AGRICULTURAL
DISTRICT TO "R-1" ONE & TWO FAMILY RESIDENCE
DISTRICT PROPERTY GENERALLY LOCATED WEST OF
NOTTINGHAM ADDITION FOR THE PURPOSE OF A
FUTURE RESIDENTIAL SUBDIVISION, AS SEPTEMBER
13 , 2004 , AT 5 : 30 P.M. IN THE COUNCIL
CHAMBERS IN CITY HALL AND INSTRUCTING CITY
CLERK TO PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5 : 30 p.m. on the 13th day of September, 2004 ,
for the purpose of considering and acting upon an application of
Norm Hayek to rezone from "A-1" Agricultural District to "R-1"
One & Two Family Residence District property generally located
west of Nottingham Addition for the purpose of a future
residential subdivision, and legally described as follows :
(A-1 to R-1) Anderson Trust
All that part of the South one-half of Section Seven
(7) in Township Eighty-eight (88) North, in Range
Thirteen (13) West of the Fifth Principal Meridian that
is within the following described boundaries :
Beginning at a point in the Northerly right-of-way line
of Old U. S . Highway 63 that is 408 .20 feet West of, and
35 . 40 feet North of the Southeast corner of the
Southwest fractional Quarter of the said Section Seven
(7) , and running thence North 0°49' 20" West, a distance
of 319 . 40 feet; thence North 23°10 ' 35" West, a distance
of 568 . 05 feet; thence North 47°24 ' 35" West, a distance
of 233 . 00 feet; thence North 9°21' 25" West, a distance
of 335 . 55 feet; thence North 10°47' 25" West, a distance
of 533 . 60 feet to a point in the North line of the
South one-half of the Northeast Quarter of the
Southwest fractional Quarter of said Section Seven (7) ,
Township and Range aforesaid, that is 976 . 10 feet West
of the East line of the said Southwest fractional
Quarter; thence East 976 . 10 feet to the Northeast
corner of the South one-half of the Northeast Quarter
of the Southwest fractional Quarter of said Section
Seven (7) ; thence South along the East line of the said
Southwest fractional Quarter to the point of its
intersection with the Northerly line of the Old U. S .
Highway 63 , and thence in a Southwesterly direction
along the said line of said Highway to the point of
beginning.
ALSO, that part of the Southeast Quarter of the said
Section Seven (7) , Township and Range aforesaid, that
is within the following described boundaries :
Beginning at a point on the West line of the said
Southeast Quarter that is 40 rods South of the
Northwest corner of the said Southeast Quarter, and
running thence East along the South line of the
Northwest Quarter of the Northwest Quarter of the said
Southeast Quarter, a distance of 205 feet ; thence South
along a line that would intersect an extension from the
Northeast, of the Northwesterly line of the Waterloo-

Eldora Road (now known as Old U. S . Highway No. 63) at a
point that is 222 feet East of the West line of the
said Southeast Quarter, a distance of 1111 feet; thence
due East to the Northwesterly right-of-way line of the
said Highway as now established; thence Southwesterly
along the said right-of-way line as now established, to
the West line of the said Southeast Quarter, and thence
North along the said West line of the Southeast Quarter
to the point of beginning.
EXCEPTING THEREFROM THE FOLLOWING:
A part of the Southeast Quarter and the Southwest
Fractional Quarter of Section No. 7, Township No. 88
North, Range No. 13 West of the Fifth Principal
Meridian in Black Hawk County, Iowa, described as
follows :
Commencing at the Southeast corner of the Southwest
Fractional Quarter of said Section; thence North 90°00'
00" West along the South line of said Section 407 . 06
feet (record 408 . 20 feet) ; thence North 00°56' 40" West
34 . 35 feet (record 35 . 40 feet) to the Northwesterly
right-of-way line of West Fourth Street and the point
of beginning; thence North 00°56' 40" West along the
Easterly line of Tract A, Southland Park Subdivision,
and its Southerly extension a distance of 319 . 61 feet
(record 319 . 40 feet) ; thence North 23°17' 41" West along
said Easterly line of Tract A, Southland Park
Subdivision 347 . 29 feet; thence South 84°52 ' 42" East
502 . 44 feet ; thence North 01°10' 42" West 234 . 02 feet;
thence North 89°16' 22" West 7 . 52 feet ; thence North
00°35' 58" East 85 . 74 feet; thence North 88°05' 48" East
278 . 29 feet to a line that is 205 . 00 feet East of the
Northwest Quarter of the Northwest Quarter of said
Southeast Quarter as measured along the South line
thereof and an intersection with the Northwesterly
right-of-way of West Fourth Street at a point that is
222 . 00 feet East of the West line of said Southeast
Quarter; thence South 01°49' 56" East along the last
described line 82 . 25 feet to a point 1111 . 00 feet South
of the South line of the Northwest Quarter of the
Northwest Quarter of said Southeast Quarter as measured
along said last described line; thence North 88°10' 04"
East 57 . 53 feet to the Northwesterly right-of-way line
of West Fourth Street ; thence South 28°37' 50" West
along said right-of-way line 698 . 02 feet; thence
Southwesterly along said right-of-way line being a
curve concave Northwesterly having a radius of 444 . 46
feet a distance of 436 . 10 feet to the point of
beginning.
EXCEPTING THEREFROM THE FOLLOWING:
That part of Section Seven (7) , Township Eighty-eight
North (T88N) , Range Thirteen West (R13W) of the Fifth
Principal Meridian, Waterloo, Black Hawk County, Iowa,
described as follows :
Begin at the most Westerly corner of Lot Two (2) ,
Nottingham First Addition, Waterloo, Black Hawk County,
Iowa; thence North 00°44 ' 00" West Seventy-seven and
Ninety-five Hundredths (77 . 95) feet along the Northerly
extension of the West line of said Lot Two (2) ; thence
South 36°40' 16" West Sixty-one and Ninety-two
Hundredths (61 . 92) feet to a point on the Northwesterly
