RESOLUTION NO. 2004-601 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE OF BEECH STREET GENERALLY LOCATED SOUTH OF DOUGLAS AND NORTH OF MARTIN LUTHER KING JR. DRIVE TO ROOSEVELT ROBY AS SEPTEMBER 27, 2004 , AT 5 : 30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5 : 30 p.m. on the 27th day of September, 2004 , for the purpose of considering and acting upon a proposal to vacate, sell and convey Beech Street generally located south of Douglas and north of Martin Luther King Jr. Drive to Roosevelt Roby Jr. , and legally described as follows : PARCEL "D" That part of Beech Street lying between the West line of Lot No. 23 of Hardy and Virden' s Plat and the East line of Koepke' s Subdivision, in the City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northeast corner of Lot No. 9 in said Koepke' s Subdivision, point being a found %" rebar with license #7811; thence due East along the East extension of the North line of Lot No. 9 in said Koepke' s Subdivision a distance of 40 . 75 feet to the West line of Lot No. 23 of said Hardy and Virden' s Plat, point being a set W" rebar with license #16264 ; thence South 00°54 ' East along said West line a distance of 125 . 6 feet to a set %" rebar with license #16264 ; thence South 58°47' West a distance of 47 . 2 feet to a point on the East line of Lot No. 7 in said Koepke' s Subdivision, being 15 . 0 feet North of the Southeast corner of said Lot No. 7, point being a found rebar with license #7811; thence North 00°54 ' West along the East lines of Lots Nos . 7, 8 and 9 of Koepke' s Subdivision a distance of 150 . 05 feet to the point of beginning. Contains 0 . 13 acres . Subject to easements of record and not of record, all in the City of Waterloo, Black Hawk County, Iowa. Note : The North line of said Lot No. 9 is assumed to bear due East for this description; for $1 . 00 , plus costs . Section 2 .
