RESOLUTION NO. 2004-648
RESOLUTION GRANTING PERMISSION TO PEGGY
HOMOLAR FOR A WAIVER FOR AN ASPHALT DRIVEWAY
TO BE LOCATED AT 4821 KIMBALL AVENUE, AND
AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Peggy Homolar be authorized and
permitted to construct an asphalt driveway with the elimination
of the sidewalk section to be located at 4821 Kimball Avenue, and
legally described as follows :
Unplatted Waterloo West, part of the Southwest 14 of the
Southwest 14 of Section 10 Township 88 Range 13 ,
commencing at a point 750 feet North of the Southwest
corner of the Southwest 14 of the Southwest IA, thence
North along the centerline of highway 585 . 8 feet,
thence East at right angles 722 feet, thence South at
right angles 645 . 8 feet, thence West at right angles
230 feet, thence North at right angles 60 feet, thence
West at right angles 492 feet to the point of
beginning, in Section 10 Township 88 Range 13 ,
excepting highway as described in Book 550 Page 325,
all in the City of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Peggy Homolar to construct an asphalt driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
