RESOLUTION NO. 2004-655 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF BEECH STREET GENERALLY LOCATED SOUTH OF DOUGLAS STREET AND NORTH OF MARTIN LUTHER KING JR. DRIVE FOR $1 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property has been made by Roosevelt Roby, Jr. in the sum of $1 . 00, plus costs and, WHEREAS, a public hearing was held on September 27, 2004 , at 5 : 30 p .m. in the Council Chambers in City Hall , Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey property owned by the City of Waterloo, Iowa, to Roosevelt Roby, Jr. , and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, described in the published notice in the Waterloo Courierully on September 15, 2004, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Roosevelt Roby, Jr. to purchase real property for the sum of $1 . 00, plus costs, be, and it is hereby accepted for real property described below: PARCEL "D" That part of Beech Street lying between the West line of Lot No. 23 of Hardy and Virden' s Plat and the East line of Koepke' s Subdivision, in the City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northeast corner of Lot No. 9 in said Koepke' s Subdivision, point being a found " rebar with license #7811; thence due East along the East extension of the North line of Lot No. 9 in said Koepke' s Subdivision a distance of 40 . 75 feet to the West line of Lot No. 23 of said Hardy and Virden' s Plat, point being a set " rebar with license #16264 ; thence South 00°54 ' East along said West line a distance of 125 . 6 feet to a set " rebar with license #16264 ; thence South 58°47' West a distance of 47 . 2 feet to a point on the East line of Lot No. 7 in said Koepke' s Subdivision, being 15 . 0 feet North of the Southeast corner of said Lot No. 7, point being a found " rebar with license #7811 ; thence North 00°54 ' West along the East lines of Lots Nos . 7, 8 and 9 of Koepke' s Subdivision a distance of 150 . 05 feet to the point f beginning.
