RESOLUTION NO. 2004-698
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF CEDAR
VALLEY GAMING CO. LLC TO REZONE FROM "C-3"
CENTRAL BUSINESS DISTRICT TO "C-P" PLANNED
COMMERCIAL PROPERTY GENERALLY LOCATED ALONG
COMMERCIAL AND JEFFERSON STREETS BETWEEN NEAR
WEST 5TH STREET AND WEST 6TH STREET FOR THE
PURPOSE OF DEVELOPING A GAMING FACILITY, AS
OCTOBER 25, 2004 , AT 5 : 30 P.M. IN THE COUNCIL
CHAMBERS IN CITY HALL AND INSTRUCTING CITY
CLERK TO PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5 : 30 p.m. on the 25th day of October, 2004 ,
for the purpose of considering and acting upon an application of
Cedar Valley Gaming Co. LLC to rezone from "C-3" Central Business
District to "C-P" Planned Commercial property generally located
along Commercial and Jefferson Streets between near West 5th
Street and West 6th Street for the purpose of developing a gaming
facility and legally described as follows :
191 West 5th Street
Lots Nos . 1, 2 , 3 , 4, 5, 6, 7, 8, 9, 10, 11, 12 , 13 and
14 , and the Southwesterly 40 feet in even width of Lot
No. 15 all in Auditor' s Plat of Cascaden and Ballou
Subdivision of Lots 26, 27 and the Northwesterly 40
feet of Lot 28 fractional Block 6 original plat West
Waterloo;
And
All that part of Lots Nos . 28, 29 and 30 in fractional
Block No. 6 in the original plat on the West side of
the Cedar River, in the City of Waterloo, Black Hawk
County, Iowa, and of the unplatted land adjoining said
lots lying Northeasterly of the Riverfront Improvement
Commission line as established, bounded as follows :
Beginning at the Westerly corner of the Southeasterly
20 feet of said Lot No. 28; thence Northeasterly along
the Northwesterly line of said Southeasterly 20 feet
and the extension of said Northwesterly line, a
distance of 252 . 67 feet; thence Southeasterly parallel
with the Southwesterly lines of said Lots Nos . 28, 29
and 30 , to the extended Southeasterly line of the
Northwesterly 43 feet of said Lot No. 30 ; thence
Southwesterly along said extended Southeasterly line a
distance of 17 . 67 feet; thence Southeasterly parallel
with the Southwesterly line of said Lot No. 30, a
distance of 17 feet to the Southeasterly line of said
Lot No. 30 ; thence Southwesterly along the
Southeasterly line of said Lot No. 30 a distance of 235
feet to the Southerly corner of said Lot No. 30 ; thence
Northwesterly along the Southwesterly line of said Lots
Nos . 30 , 29 and 28 to the point of beginning, in the
City of Waterloo, Black Hawk County, Iowa;

The Southeasterly fifty-one and one-half (51%) feet of

The Southeasterly thirty (30) feet of the Southwesterly
eighty (80) feet of Lot No. Seven (7) in Block No. Nine

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
