RESOLUTION NO. 2004-699
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF ISLE OF
CAPRI CASINOS, INC. TO REZONE FROM "A-1"
AGRICULTURAL DISTRICT AND "C-2" COMMERCIAL
DISTRICT WITH CONDITIONS TO "C-P" PLANNED
COMMERCIAL PROPERTY GENERALLY LOCATED AT THE
NORTHEAST CORNER OF SHAULIS ROAD AND HESS
ROAD FOR THE PURPOSE OF DEVELOPING A GAMING
FACILITY, AS OCTOBER 25, 2004 , AT 5 : 30 P.M.
IN THE COUNCIL CHAMBERS IN CITY HALL AND
INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF
HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5 : 30 p.m. on the 25th day of October, 2004 ,
for the purpose of considering and acting upon an application of
Isle of Capri Casinos, Inc . to rezone from "A-1" Agricultural
District and "C-2" Commercial District with conditions to "C-P"
Planned Commercial property generally located at the northeast
corner of Shaulis Road and Hess Road for the purpose of
developing a gaming facility and legally described as follows :
A-1 to C-P
All that part of Section Twelve (12) , Township Eight-
eight North (T88N) , Range Thirteen West (R13W) of the
Fifth Principal Meridian, City of Waterloo, Black Hawk
County, Iowa, described as follows :
West of the Westerly Right-of-Way of Existing relocated
Primary Road No. U. S . 218 ; South of the South Right-of-
Way line of Existing relocated Primary Road No. U. S .
218 and Existing Primary Road No. U. S . 20; East of the
East Right-of-Way line of Hess Road; North of the
following described line as per Document No. 2003-
22609, Black Hawk County Recorder' s Office; Commencing
at the West Quarter Corner of aforesaid Section Twelve
(12) ; thence South 00°05' 15" East One Thousand Three
Hundred Fifteen and Twenty-nine Hundredths (1315 . 29)
feet along the West Line of the Southwest Quarter of
said Section Twelve (12) ; thence North 89°45' 45" East
Sixty (60 . 00) feet to the Point of Beginning; thence
continuing North 89°45' 45" East One Thousand Two
Hundred Sixty and Thirty-five Hundredths (1260 . 35) feet
along an existing fence; thence North 89°22 ' 43" East
One Thousand Three Hundred Twenty and Thirty-five
