RESOLUTION NO. 2004-725
RESOLUTION GRANTING PERMISSION TO GENE SHEETZ
FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE
LOCATED AT 611 ROOFF AVENUE, AND AUTHORIZING
CONSTRUCTION OF A CONCRETE DRIVEWAY AND
PLACING A DRIVEWAY OR SIDEWALK ON CITY RIGHT-
OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Gene Sheetz be authorized and
permitted to construct a concrete driveway and placing a driveway
or sidewalk on City right-of-way on an unimproved street to be
located at 611 Rooff Avenue, and legally described as follows :
Lot 23 , 24 , 25 & 26, Block Number 7, Sunshine
Subdivision, City of Waterloo, Black Hawk County, State
of Iowa,
And
That part of Section Thirty (30) , Township Eighty-Nine
North (T89N) , Range Twelve West (R12W) of the Fifth
Principal Meridian (5th P.M. ) , City of Waterloo, Black
Hawk County, State of Iowa, described as follows :
Beginning at a point on the West line of the Illinois
Central Railroad Company right of way, said point at
the intersection of said West line and the
Northeasterly line of the Illinois Central Railroad
Company right of way running Southeasterly through said
section parallel to Dubuque Road, also known as the
Southeast corner of Lot Twenty-Six (26) in Block Seven
(7) in the Sunshine Subdivision in said City of
Waterloo; thence running South 48°41' 02" East One
Hundred Thirty-Three and Ten Hundredths (133 . 10) feet
along said Northeasterly line of the Illinois Central
Railroad Company right of way running Southeasterly
through said section parallel to Dubuque Road, to the
East line of the Illinois Central Railroad Company
right of way; thence North 00°02 ' 08" West Three Hundred
Ninety-Nine and Fifty-Eight Hundredths (399 . 58) feet
along said East line of the Illinois Central Railroad
Company right of way to a point of intersection with an
extension of the North line of Lot Twenty-Three (23) in
said Block Seven (7) in the Sunshine Subdivision in the
City of Waterloo; thence South 89°59' 41" West One
Hundred and No Hundredths (100 . 00) feet along said
extension of the North line of Lot Twenty-Three (23) to
a point on the West line of said right of way, said
point is also known as the Northeast corner of said Lot
Twenty-Three (23) ; thence South 00°02 ' 08" East Three
Hundred Eleven and Sixty-Two Hundredths (311 . 62) feet
along said West line of said right of way, also known
as the East line of Lots Twenty-Three (23) , Twenty-Four
(24) , Twenty-Five (25) , and Twenty-Six (26) , to the
point of beginning, area containing Thirty-Five
Thousand Five Hundred Sixty-Eight and Three Tenths
(35, 568 . 3) square feet or zero and Eight Hundred
Seventeen Thousandths (0 . 817) acres, in the City of
Waterloo, Black Hawk County, Iowa;

WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Gene Sheetz to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this 25th day of October, 2004 .
