RESOLUTION NO. 2004-777
RESOLUTION APPROVING RELEASE OF REAL ESTATE
MORTGAGE FOR DELBERT AND CAROLYN KAUFMAN,
9215 KIMBALL AVENUE, FOR PAYMENT OF
PROMISSORY NOTE IN CONJUNCTION WITH THE
KIMBALL SOUTH RURAL WATER MAIN PROJECT AND
DIRECTING EXECUTION OF SAID RELEASE OF REAL
ESTATE MORTGAGE BY MAYOR.
WHEREAS, Delbert and Carolyn Kaufman, 9215 Kimball Avenue,
have paid the Waterloo Water Works the remaining balance of the
Promissory Note and Mortgage in conjunction with the Kimball
South Rural Water Main Project for the following described
property:
That part of the Northwest Quarter (NW'A) of Section No.
Three (3) , Township No. Eighty-seven (87) North, Range
Thirteen (13) West of the Fifth Principal Meridian in
Black Hawk County, Iowa, described as follows :
Commencing at a point on the North line of said Section
that is Six Hundred (600 . 0) feet West of the Westerly
right-of-way line of Iowa Highway No. 21 (formerly Iowa
Highway No. 402) ; thence Southerly parallel with said
Westerly right-of-way line a distance of One Thousand
Six Hundred Thirty-three and 25/100' s (1, 633 . 25) feet;
thence West parallel with the North line of said
Section a distance of Nine Hundred Fifty-five and
45/100' s (955 .45) feet to the point of beginning;
thence West a distance of Nine Hundred Seventy-five and
36/100' s (975 . 36) feet to a point that is One Thousand
One Hundred Eighty Six and no/100' s (1, 186 . 0) feet
North of the South line of said Northwest Quarter
(NW1/) ; thence North 89°59' 00" West a distance of
Seventeen (17 . 0) feet; thence North 0°14 ' 54" West along
the East right-of-way line of Kimball Avenue a distance
of Four Hundred Four and 17/100 ' s (404 . 17) feet; thence
East along said right-of-way line a distance of
Seventeen (17) feet; thence North 0°14 ' 54" West along
said right-of-way line a distance of One Hundred Nine
and 63/100' s (109 . 63) feet; thence North 89°48' 04" East
a distance of Nine Hundred Eighty and 84/100' s (980 . 84)
feet ; thence South 0°21' 35" West a distance of Five
Hundred Seventeen and 22/100 ' s (517 . 22) feet to the
point of beginning, except that part thereof conveyed
to Black Hawk County, Iowa, . for road purposes, all in
the City of Waterloo, Black Hawk County, Iowa.
Note : The North line of the Northwest Quarter (NW1A) is
assumed to bear East-West .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Release of Real Estate Mortgage dated
November 8, 2004 , for payment of Promissory Note in conjunction
with the Kimball South Rural Water Main Project, by and between
Delbert and Carolyn Kaufman, 9215 Kimball Avenue, and the City of
Waterloo, Iowa, be and the same is hereby approved and the Mayor
authorized to execute the same in behalf of the City of Waterloo,
Iowa.
