RESOLUTION NO. 2004-784
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE PAVE BOX AND PREVENTION OF FURTHER DAMAGE
AT 2272 INDEPENDENCE AVENUE.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owner of the premises known as 2272 Independence
Avenue to have the pave box repaired and further damage
prevented, and
WHEREAS, the property owner failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 2272 Independence
Avenue, in the City of Waterloo, Iowa, to comply with Ordinance
No. 1118 of the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 29th day of October, 2004 , a report filing
claim for the repairing of the pave box and preventing further
damage at above described premises and same met all the
requirements of the City ordinance and have been fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:

Legal Description:
West 1 Acre of the East 2 Acres of the North Half of
the West One-Quarter of the Northeast Quarter of the
Northwest Quarter of Section No. 29, Township No. 89
North, Range No. 12 West of the Fifth Principal
Meridian, in the City of Waterloo, Black Hawk County,
Iowa, except that part thereof described as follows :
Beginning at a point on the East line of said West 1
Acre that is 462 . 7 feet South of the Northeast corner
of said West 1 Acre; thence South to the Southeast
corner of said West 1 Acre; thence West to the
Southwest corner of said West 1 Acre; thence North
along the West line of said West 1 Acre to a point that
is 473 . 9 feet South of the Northwest corner of said
West 1 Acre; thence Northeasterly to the point of
beginning.
Unpaid Assessment : $504 . 00
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 2272 Independence Avenue in the
City of Waterloo, Iowa, the amount of $504 . 00, said assessment
shall bear interest from the date of levy of the assessment, viz :
November 8 , 2004, at the rate of nine (9) percent per annum until
paid on all the unpaid amount of this assessment certified to the
County Treasurer of Black Hawk County, Iowa, and

H s BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby instructed to notify Joshua R. Smith of said property,
get"ordingly and also instructed to certify said assessment to the
C t my Treasurer of Black Hawk County, Iowa, to be entered upon

tax list to be collected as other taxes, as provided by law,
