Htrl RESOLUTION ORDERING THE CONSTRUCTION OF THE
o [-, 2004 TIBBITTS BASEBALL COMPLEX FENCING
PROJECT.
c a) WHEREAS, by Resolution No. 2004-818, plans, specifications,
s e . , for the 2004 Tibbitts Baseball Complex Fencing Project, in
s tlxe City of Waterloo, Iowa, have been approved and adopted by
o tlg.is Council after the hearing prescribed by statute.

CA o NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF

W1TERLOO, IOWA, that it is deemed advisable and necessary and it

is so ordered on motion by this Council that the said
improvements be constructed in accordance with said plans and
scifications .
c That the work herein ordered is to be paid in monthly
eSimates, in cash, on the basis of 90 percent of the work as the
same is completed and materials delivered and the work approved,
eXcept that before the last month ' s payment is made the
cc itractor may be required to furnish the City Council vouchers
slowing that all subcontractors and workmen and persons
furnishing materials have been fully paid for such materials and
Libor, and that the City may retain the last month' s payment for
a ` period of 31 days following such completion and approval,
unless satisfied that materials, men and laborers have been paid.
That said work shall be done by contract and shall be
cot4menced promptly after receipt of "Notice to Proceed" .
PASSED AND ADOPTED this 6th day of December, 2004 .
