PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date, time and place above set out. The tentative agenda for said meeting is as follows: • Resolution fixing date for a meeting on the proposal to reallocate certain unspent proceeds of the Taxable General Obligation Bonds, Series 2001A and General Obligation Bonds, Series 2003A, of Waterloo, Iowa, and providing for publication of notice thereof Such additional matters as are set forth on the additional 7 page(s) attached hereto. There were present Mayor Tim Hurley , in the chair, and the following named Council Members: Cole , Greenwood, Clark, Schmitt , Gunderson , Welper Absent: Kincaid * * * * * * * -1- Council Member Greenwood introduced the following Resolution entitled "RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE TAXABLE GENERAL OBLIGATION BONDS, SERIES 2001A AND GENERAL OBLIGATION BONDS, SERIES 2003A, OF WATERLOO, IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF", and moved that the same be adopted. Council Member Cole seconded the motion to adopt. The roll was called and the vote was, AYES: Cole , Greenwood , Clark , Schmitt , Gunderson, Welper NAYS: none Whereupon, the Mayor declared the resolution duly adopted as follows: RESOLUTION NO . 2004-829 RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE TAXABLE GENERAL OBLIGATION BONDS, SERIES 2001A AND GENERAL OBLIGATION BONDS, SERIES 2003A, OF WATERLOO, IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS, pursuant to a Resolution approved on June 18, 2001, the City Council of the City of Waterloo, Iowa has previously issued its Taxable General Obligation Bonds, Series 2001A, in the aggregate principal amount of$410,000 (the "Series 2001A Bonds"), for the purpose of paying costs of payment of extraordinary legal obligations, including retirement sick leave buyout; and WHEREAS, certain proceeds of the Series 2001A Bonds remain unspent, and City staff has recommended that approximately $15,770 of such unspent proceeds be applied for the purpose of defraying all or a portion of the costs of the acquisition and demolition of abandoned, dilapidated or dangerous buildings, structures or properties; and WHEREAS, pursuant to a Resolution approved on June 10, 2003, the City Council of the City of Waterloo, Iowa has previously issued its General Obligation Bonds, Series -2- 2003A, in the aggregate principal amount of$8,825,000 (the "Series 2003A Bonds"), for the purpose of paying costs of the reconstruction, extension and improvement of the Waterloo Municipal Airport; the acquisition, development and improvement of GIS/GPS mapping systems and components; the acquisition, construction and improvement of real and personal property useful for the protection of property from floods or high waters, including flood plain alleviation and relocation expenditures; the construction, reconstruction and repairing of street, sidewalk and intersection improvements; the acquisition of vehicles and equipment for the police, fire and street departments; the rehabilitation and improvement of City parks and the acquisition, repair and replacement of facilities, equipment and improvements commonly found in City parks; and the acquisition, improvement and installation of traffic control devices and street lighting fixtures; and WHEREAS, certain proceeds of the Series 2003A Bonds remain unspent, and City staff has recommended that approximately $31,678 of such unspent proceeds (the above- referenced amounts being hereinafter referred to in the aggregate as the "Unspent Proceeds") be applied for the purpose of defraying all or a portion of the costs of the acquisition and demolition of abandoned, dilapidated or dangerous buildings, structures or properties; and WHEREAS, there being no procedure specified under Iowa law for consideration or approval of such a reallocation, it is hereby determined, pursuant to Section 364.6 of the Code of Iowa, that the procedure set forth in Section 384.25 should apply and that a hearing be held upon the proposal to reallocate the Unspent Proceeds to provide funds for acquisition and demolition of abandoned, dilapidated or dangerous buildings, structures or properties. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That this Council meet in the Council Chambers, City Hall, Waterloo, Iowa, at 5 : 30 o'clock P .M., on the 2 0 t h day of December , 200 4 , for the purpose of taking action on the matter of the proposed reallocation of the Unspent Proceeds of the Series 2001A Bonds and Series 2003A Bonds to provide funds for acquisition and demolition of abandoned, dilapidated or dangerous buildings, structures or properties. Section 2. That the City Clerk is hereby directed to cause one publication to be made of notice of said meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in said City, said -3- publication to be not less than four clear days nor more than twenty days before the date of said public meeting. Section 3. The notice of the proposed action shall be in substantially the following form: -4- NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, ON THE MATTER OF THE PROPOSED REALLOCATION OF CERTAIN UNSPENT PROCEEDS OF THE TAXABLE GENERAL OBLIGATION BONDS, SERIES 2001A AND GENERAL OBLIGATION BONDS, SERIES 2003A, OF THE CITY OF WATERLOO, IOWA, AND THE PUBLIC HEARING THEREON PUBLIC NOTICE is hereby given that the Council of the City of Waterloo, Iowa, will hold a public hearing on the 2 0 t h day of December , 200 4 , at 5 : 3 0 o'clock P .M., in the Council Chambers, City Hall, Waterloo, Iowa, at which meeting the Council proposes to take additional action for the reallocation of certain unspent proceeds of the Taxable General Obligation Bonds, Series 2001A (the "Series 2001A Bonds") and General Obligation Bonds, Series 2003A (the "Series 2003A Bonds") of the City of Waterloo, Iowa, in the aggregate amount of not to exceed $48,000, in order to provide funds to pay costs of the acquisition and demolition of abandoned, dilapidated or dangerous buildings, structures or properties. Any person interested may appear at the public hearing, either orally or in writing, and be heard as to the reallocation of said proceeds of the Series 2001A Bonds and Series 2003A Bonds for the above purposes. This Notice is given by order of the Council of Waterloo, Iowa, as provided by Sections 364.6 and 384.25 of the Code of Iowa, 2003, as amended.
