RESOLUTION NO. 2003-70
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PROPERTY GENERALLY LOCATED AT
THE SOUTHWEST CORNER OF WALKER STREET AND
LONGFELLOW AVENUE FOR $1 . 00 AND OTHER
VALUABLE CONSIDERATION, PLUS COSTS, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AND DELIVER A DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $1 . 00 and other valuable consideration,
plus costs, has been made by the Waterloo Schools, and
WHEREAS, a public hearing was held on February 3 , 2003 , at
5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to the Waterloo Schools, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
January 22 , 2003 , is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer of the Waterloo Schools to purchase real
property for the sum of $1 . 00, and other valuable consideration
and costs be, and it is hereby accepted for real property
described below:
A part of Lots B, C and D, Cedar Dale, Waterloo, Black
Hawk County, Iowa described as follows :
Commencing at the intersection of the North right-of-
way line of Parker Street and the West right-of-way
line of Longfellow Avenue; thence North 00°32 ' 35" East
along the West right-of-way line of Longfellow Avenue a
distance of 344 . 90 feet to the point of beginning;
thence North 89°26' 25" West a distance of 87 . 56 feet;
thence South 55°42 ' 07" West a distance of 30 . 84 feet;
thence Northwesterly along a non-tangent curve concave
Southwesterly having a radius of 1697 . 50 feet and a
long chord bearing North 29°00' 48" West a distance of
317 . 64 feet; thence Northwesterly along a non-tangent
curve concave Southwesterly having a radius of 881 . 83
feet and a long chord bearing North 41°33 ' 07" West a
distance of 218 . 11 feet; thence North 48°38 ' 16" West a
distance 497 . 00 feet; thence Northwesterly along a
curve concave Southwesterly having a radius of 531 . 22
feet and a long chord bearing North 62°42 ' 22" West a
distance of 260 . 87 feet; thence North 00°14 ' 35" East a
distance of 50 . 80 feet to the South right-of-way line
of Walker Street; thence South 89°45 ' 25" East along

real property to the Waterloo Schools by Deed.
'4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to the Waterloo Schools .
5 . That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council .
6 . That the City Clerk is authorized and directed to
deliver said deed of conveyance to the Waterloo Schools upon
receipt of the sum of $1 . 00 and other valuable consideration, and
costs .
PASSED AND ADOPTED this 3rd day of February, 2003 .
