r' WHEREAS, Steve and Barbara Klabunde, 6812 Kimball
Avenue, have paid the Waterloo Water Works the remaining
balanceof the Promissory Note and Mortgage in conjunction
with the ; Kimball South Rural Water Main Project for the
followingdescribed property:
That part of the Southeast Quarter (SE%) of
Section Twenty-one (21) , Township Eighty-eight
(88) North, Range Thirteen (13) West of the Fifth
Principal Meridian in Black Hawk County, Iowa,
described as follows :
Beginning at a point on the East line of said
Southeast Quarter (SE%) which point is Six Hundred
Fifty and 07/100 ' s (650 . 07) feet Northerly of the
Southeast corner of said Southeast Quarter (SE%) ;
thence North 89°09' 45" West Four Hundred Thirty
(430 . 0) feet ; thence North 00°00' 44" West Four
Hundred Fifty (450 . 0) feet; thence South 89°09' 45"
East Four Hundred Thirty (430 . 0) feet to the East
line of said Southeast Quarter (SE1/) ; thence South
00°00 ' 45" East Four Hundred Fifty (450 . 0) feet
along said line to the point of beginning.
Said parcel contains 4 . 44 acres, more or less .
The East line of said Southeast Quarter (SE1%) is
assumed to bear South 00°00' 44" East in this
description, all in the City of Waterloo, Black
Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the Release of Real Estate
Mortgage dated February 10 , 2003 , for payment of Promissory
Note in conjunction with the Kimball South Rural Water Main
Project, by and between Steve and Barbara Klabunde, 6812
Kimball Avenue, and the City of Waterloo, Iowa, be and the
same is hereby approved and the Mayor authorized to execute
the same in behalf of the City of Waterloo, Iowa .
PASSED AND ADOPTED this 10th day of February, 2003 .
