RESOLUTION NO. 2003-102 RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE GIVEN ON APPLICATION OF MENARD' S, INC. TO REZONE FROM "R-2" ONE & TWO FAMILY RESIDENCE DISTRICT AND "R-4" MULTIPLE FAMILY RESIDENCE DISTRICT TO "C-2" COMMERCIAL DISTRICT PROPERTY GENERALLY LOCATED IMMEDIATELY NORTH OF THE EXISTING MENARD' S OUTSIDE SALES YARD AND EAST OF HAMMOND AVENUE TO ALLOW FOR A MENARD' S HOME IMPROVEMENT BUILDING SUPPLY STORE, AS MARCH 10 , 2003 , AT 5 : 30 P .M. IN THE COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF HEARING. WHEREAS, the Council of the City of Waterloo, Iowa, shall meet in the Council Chambers in the City Hall in the City of Waterloo, Iowa, at 5 : 30 p.m. on the 10th day of March, 2003 , for the purpose of considering and acting upon an application of Menard' s, Inc . to rezone from "R-2" One & Two Family Residence District and "R-4" Multiple Family Residence District to "C-2" Commercial District property generally located immediately north of the existing Menard' s outside sales yard and east of Hammond Avenue to allow for a Menard' s home improvement building supply store, legally described as follows : Parcel 1 The West 323 feet of the North 6 rods of the Southwest Quarter of the Southwest Quarter of Section No. 2 , Township 88 North, Range No. 13 West of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa; except the South 45 feet thereof . And the East 164 feet of the West 487 feet of the North 6 rods and the South 45 feet of the West 323 feet of the North 6 rods of the Southwest Quarter of the Southwest Quarter of Section No. 2 , Township No. 88 North, Range No. 13 West of the Fifth Principal Meridian, in Black Hawk County, Iowa, except all legal highways . Parcel 2, A parcel of land located in the Southwest 1/, Southwest 1/ of Section 2-88-13 , Waterloo, Black Hawk County, Iowa, described as follows : Commencing at the Southwest corner of said Southwest 1/; thence North 0°00' 00" East along the West line of said Southwest 1/ a distance of 800 . 99 feet ; thence North 89°43 ' 34" East a distance of 33 . 00 feet to the East right-of-way line of Hammond Avenue; thence North 89°43 ' 34" East parallel to and 519 . 00 feet normally distance from the South line of the South 40 acres of the North 3, Southwest 1/ of Section 2-88-13 a distance of 451 . 21 feet to the point of beginning; thence North 89°43' 34" East a distance of 442 . 27 feet to the Northwesterly right-of-way line of East San Marnan Drive; thence South 48°29' 41" West along said Northwesterly right-of-way line a distance of 332 . 61 feet ; thence North 41°30' 19" West a distance of 291 . 51 feet to the point of beginning.
