RESOLUTION NO. 2003-115 RESOLUTION GRANTING PERMISSION TO DAVID HEIDEMAN FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE LOCATED AT 2971 CEDAR TERRACE DRIVE, AND AUTHORIZING CONSTRUCTION OF A CONCRETE DRIVEWAY ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: WHEREAS, the City Engineer has made written application to the City Council asking that David Heideman be authorized and permitted to construct a concrete driveway on City right-of-way on an unimproved street to be located at 2971 Cedar Terrace Drive, and legally described as follows : Unplatted Waterloo West part of Government Lot 4 Section 12 Township 88 Range 13 described as commencing at the intersection of the East line of said Section 12 and the Northeasterly line of the Highway lying Northeasterly of the right of way of the Chicago Rock Island & Pacific Railroad thence North 53° and 26' West 363 . 2 feet along the North line of the public road thence North parallel with the East line of the Section 477 . 6 feet thence West at right angle 208 feet thence North at right angle 291 feet to the south bank of the Cedar River thence Easterly along the South bank of the Cedar River to a point on the East line of said Section 12 which is 814 . 8 feet North of the point of beginning thence South along the East line of the said Section 814 . 8 feet to the Northeasterly line of the public road which is the point of beginning and easement and except commencing 412 . 2 feet North and 100 feet West of East 1/ corner Section 12 thence West at an angle 90° 191 feet thence South at an angle 90° 342 . 32 feet to Northeast line County Road 258 thence at an angle 53°20' to the left in a Southeasterly direction along Northeast line said road to a point 100 feet West and parallel to East line section thence North along a line that is 100 feet West and parallel to East line section to point of beginning except that part described as follows : Commencing the intersection of the East line of said Section 12 with the Northeasterly line of the highway that lies Northeasterly of the right-of-way of the former Chicago, Rock Island & Pacific Railroad thence northwesterly along said highway to a point which is 291 feet West (as measured at right angles) from the East line of section thence North 00°09' Ol" East parallel with the East line of said Section a distance of 477 . 77 feet (recorded as North 00°09' O1" East 477 . 6 feet) to the point of beginning point being found 5/8 inch rebar license #12088 thence North 89°56' West 208 . 06 feet (recorded as North 89°56' 38" West 208 feet) to a found 5/8 inch rebar with license #12088 thence North 00°09' 52" East a distance of 375 feet more or less to the South bank of the Cedar River (thence North 00°09' 5" East a distance of 291 . 04 feet) to a meander point point being a found 5/8 inch rebar with license #12088 thence Southeasterly along said South bank of the Cedar River (thence South 74°35' 32" East along a meander line a distance of 215 . 59) feet to a meander point point being a set % inch rebar with license #6505 thence South 00°09' 0l" West a distance of 81 feet more or less to said meander point point being a set inch rebar with license #6505 thence South 00°09' Ol" West a distance 234 feet to the point of beginning also known as parcel "D" also together with a beneficial easement for access and utility purposes described in Misc B 331 P 213 , all in the City of Waterloo, Black Hawk County, Iowa; Resolution No. 2003-115 Page 2 and WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to David Heideman to construct a concrete driveway subject to the following conditions : 1 . Removal and replacement of this driveway to an official elevation at no additional expense to the City of Waterloo at such time that sidewalk is constructed. 2 . Removal and replacement of the private driveway, as needed, to an official elevation at no additional expense to the City of Waterloo at such time that curb and gutter is constructed. 3 . Agrees to pay for any additional expense for the replacement of any special textured driveway or sidewalk that has been removed for any City of Waterloo project . 4 . Employment of a bonded contractor who shall obtain a permit from the office of the City Engineer. 5 . Construction of the driveway according to the specifications and policies of the City Engineer and under his supervision. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
