RESOLUTION NO. 2003-119 RESOLUTION ACCEPTING AND APPROVING CERTAIN PURCHASE AGREEMENTS, PERMANENT AND TEMPORARY EASEMENT AGREEMENTS AND DIRECTING EXECUTION OF SAID AGREEMENTS BY MAYOR. WHEREAS, the purchase and easement agreements of the hereinafter described parcels are necessary to carry out the San Marnan Drive Traffic Improvements Project, Phase II , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the purchase agreements and permanent and temporary easement agreements for the parcels hereinafter described, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City. The subject parcels are : Parcel No. 1 : 8813-02-302-031 Owners : C. James Mittan, Trustee of C. James Mittan Revocable Trust Jeannine C. Mittan, Trustee of Jeannine C. Mittan Revocable Trust Temporary Rasemenfi : That part of Lot Twenty-six (26) , Richland Park, Waterloo, Iowa, except the Northwesterly One Hundred Seventy (170) feet thereof, and that part of unplatted Southwest Quarter (SW'%) , Section Two (2) , Township Eighty-eight North (T88N) , Range Thirteen West (R13W) of the Fifth Principal Meridian, City of Waterloo, Iowa, described as follows : That part of the above described property lying Southwesterly of the Southwesterly line of Flammang Drive and Northeasterly of a line which is Fifteen (15) feet Southwesterly of, normally distant from and parallel with said Flammang Drive, said line extending Southeasterly to the Northerly line of the San Marnan Frontage Road, except that part lying within Two (2) feet of the existing building as shown on the attached plat of easement .
