t= �' WHEREAS, Russell and Marla Betts, 9140 Kimball Avenue,
ave ` pai ;the Waterloo Water Works the remaining balance of
the Promissory Note and Mortgage in conjunction with the
Kir all 'South Rural Water Main Project for the following
described property:
That part of the Northeast Quarter (NE'<i) of
Section No. 4 (4 ) , Township No. Eighty-seven (87)
North, Range Thirteen (13) West of the Fifth
Principal Meridian in Black Hawk County, Iowa,
described as follows :
Beginning at a point on the East line of said
Section that is One Thousand Seventy-two and
5/100' s (1, 072 . 05) feet South of the Northeast
corner of said Section; thence West at right
angles Five Hundred Eighty-five and 89/100' s
(585 . 89) feet; thence South at right angles One
Hundred Twenty (120. 0) feet; thence East at right
angles Five Hundred Eight-five and 89/100' s
(585 . 89) feet to the East line of said Section;
thence North along said East line One Hundred
Twenty ( 120. 0) feet to the point of beginning,
except the East Fifty (50) feet thereof, all in
the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the Release of Real Estate
Mortgage dated March 31, 2003, for payment of Promissory
Note in conjunction with the Kimball South Rural Water Main
Project, by and between Russell and Marla Betts, 9140
Kimball Avenue, and the City of Waterloo, Iowa, be and the
same is hereby approved and the Mayor authorized to execute
the same in behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 31st day of March, 2003.
