RESOLUTION NO. 2003-221
RESOLUTION GRANTING PERMISSION TO BRAD AND
DANA MEYER FOR A WAIVER FOR AN ASPHALT
DRIVEWAY TO BE LOCATED AT 3545 RANCHERO ROAD,
AND AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION AND PLACING A DRIVEWAY ON CITY RIGHT-
OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Brad and Dana Meyer be authorized and
permitted to construct an asphalt driveway with the elimination of
the sidewalk section and placing a driveway on City right-of-way
on an unimproved street to be located at 3545 Ranchero Road, and
legally described as follows :
All that part of the Northwest Quarter and the
Northeast Quarter of Section 12 , Township 88 North,
Range 14 West of the 5th Principal Meridian, Waterloo,
Black Hawk County, Iowa, described as follows :
Commencing at the Northeast corner of the Northwest
Quarter of said Section 12 ; thence South 00°40' 33" East
on the East line of the Northwest Quarter of said
Section 12 a distance of 33 . 00 feet to the point of
beginning, said point of beginning being on the present
South right-of-way line of Ranchero Road; thence North
89°09' 55" East on the present South right-of-way line
of Ranchero Road a distance of 96 . 69 feet; thence South
00°48' 12" East a distance of 250 . 06 feet; thence South
89°11' 48" West on a line that is 283 . 00 feet South of
and parallel with the North line of the Northwest
Quarter of said Section 12 a distance of 522 . 72 feet;
thence North 00°48' 12" West a distance of 250 . 00 feet
to the present South right-of-way line of Ranchero
Road; thence North 89°11' 48" East on the present South
right-of-way line of Ranchero Road a distance of 426 . 03
feet to the point of beginning.
The North line of the Northwest Quarter of said Section
12 bears North 89°11' 48" East for the purpose of this
description.
By survey containing 130, 683 square feet or 3 . 00 acres,
all in the City of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Brad and Dana Meyer to construct an asphalt
driveway subject to the following conditions :
1 . Removal and replacement of this driveway to an official
elevation at no additional expense to the City of
Waterloo at such time that sidewalk is constructed.

2 . Removal and replacement of the private driveway, as
needed, to an official elevation at no additional
expense to the City of Waterloo at such time that curb
and gutter is constructed.
3 . Agrees to pay for any additional expense for the
replacement of any special textured driveway or
sidewalk that has been removed for any City of Waterloo
project .
4 . Employment of a bonded contractor who shall obtain a
permit from the office of the City Engineer.
5 . Construction of the driveway according to the
specifications and policies of the City Engineer and
under his supervision.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
