RESOLUTION NO. 2003-336
RESOLUTION GRANTING PERMISSION TO RONALD ERNE
FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE
LOCATED AT 2955 LAFAYETTE STREET, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Ronald Erne be authorized and
permitted to construct a concrete driveway with the elimination
of the sidewalk section due to the inability to meet requirements
of the driveway and sidewalk policy, paragraph 1 to be located at
2955 Lafayette Street, and legally described as follows :
Unplatted Waterloo East part Southeast Southeast
Section 30 Township 89 Range 12 described as follows :
Commencing at a point on Northeasterly line Lafayette
Street which point is 480 . 01 feet Southeasterly from
intersection of Northeasterly line Lafayette with the
West line Southeast Southeast said Section 30 thence
North 30°21' 26" West a distance of 105 . 20 feet thence
North 64°36' 59" West a distance of 15 feet thence North
25°07' 57" West a distance of 92 . 54 feet thence North
12°50' 14" West a distance of 106 . 58 feet thence North
24°57' 36" East a distance of 59 . 44 feet to
Southwesterly right-of-way of Chicago Central & Pacific
Railroad thence South 65°05' 45" East along said right-
of-way line a distance of 497 . 96 feet thence South
24°57' 36" West a distance of 263 . 49 feet to
Northeasterly line Lafayette Street thence North
65°02 ' 24" West along Northeasterly line Lafayette
Street a distance of 260 . 15 feet to point of beginning
except that part deeded to City of Waterloo as
described in Land Deed Book 560 Page 657, all in the
City of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Ronald Erne to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
