This Resolution prepared by Nancy Eckert, City Clerk, 715 Mulberry Street, Waterloo, Iowa. RESOLUTION NO. 2003-454 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF VACATED RIGHT-OF-WAY GENERALLY LOCATED AT THE INTERSECTION OF MELISSA LANE AND SONYA DRIVE TO EYE CO. LLC FOR $2, 534 .22, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $2, 534 .22, plus costs, has been made by Eye Co. LLC, and WHEREAS, a public hearing was held on July 7, 2003, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Eye Co. LLC, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on June 27, 2003, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Eye Co. LLC to purchase real property for the sum of $2, 534 .22 and costs be, and it is hereby accepted for real property described below: That part of Melissa Lane, as platted in Sturdy Addition, Waterloo, Iowa, described as follows: Commencing at the Southwest corner of Lot Four (4) , Sturdy Addition; thence North Twelve and Fifty-seven Hundredths (12.57) feet to the point of beginning, said point also being the beginning of a Fifty (50) foot radius curve as platted in said Addition; thence Northerly along said Fifty (50) foot radius curve to the Southeast corner of Lot Six (6) in said Addition; thence South along the Southerly extension of the East line of said Lot Six (6) Thirty-two and Ninety-six Hundredths (32. 96) feet to a point which is Sixteen (16) feet radially distant from the existing back of curb on said Melissa Lane; thence Southeasterly Fifty-six and Forty- six Hundredths (56. 46) feet parallel with said curb along a Sixty-two and Thirty-two Hundredths (62.32) foot radius curve, concave Westerly to a point of tangency; thence South Seven and Seventy-two Hundredths (7. 72) feet to the point of beginning, subject to the city' s retention of an easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa. @sM 'mot; iM' To. 2003-454 O t —4 C) cot11O 00 ›.+ }- 0vHa t k s ' at the City of Waterloo, Iowa, convey said parcel of Atr,. sty to Eye Co.
